Belated challenge to seniority list can't be entertained: HC | | | Early Times Report
Jammu, Dec 09 : High court judge Alok Aradhe today held that in the absence of any satisfactory explanation for delay in questioning the validity of the inter se seniority assigned, the belated challenge to the seniority list could not be entertained. "In service jurisprudence, immense sanctity is attached to the final seniority list which once published can't be disturbed at the behest of a person who chooses not to challenge it for four years. The sanctity of the seniority list must be maintained unless there are very compelling reasons to do so in order to do substantial justice," he observed. The court directive came in a petition, seeking the quashment of October 8, 2013 seniority list of naib-tehsildars insofar it pertains to inter se seniority of the petitioners and respondents from No 4 to 75 notified by the financial commissioner. The petitioners had also sought a direction to the respondents 1 and 2 to fix their inter se seniority and respondents 4 to 75 as naib-tehsildars in the order of merit obtained by them in the selection process after preparation of combined merit list of the candidates selected pursuant to advertisement notices dated April 26, 2002, December 14, 2005 and May 26, 2008.(JNF) |
