CJ seeks personal appearance of GAD secy | | | Early Times Report
Jammu, Dec 17 : In a contempt petition, seeking implementation of December 23, 2015 court judgment as regards the appointment of petitioners and fixation of their seniority as per the select list, Chief Justice N Paul Vasanthakumar today directed GAD secreatry to appear in person on December 31, 2016 and state as to why the order of this court was not implemented. Petitioners -- Varun Bedi and Parshant Sharma - have sought quashment of the select list of junior stenographers in so far as it pertains to the allocation of GAD to respondents and direction to state to allocate GAD to both them keeping in view their merit position in the select list. The court, after hearing the counsel for petitioners, allowed the petition with a direction to GAD secretary to issue appointment orders in favour of petitioners as junior scale stenographers in GAD with effect from the date other candidates were appointed. The court said though the petitioners were selected and recommended for appointment, they had not been able to take the appointment orders because of allotment of departments by the board in an arbitrary manner. "Their appointment, therefore, shall be given effect from the date appointment orders were issued in favour of other candidates selected and allotted GAD but without any monetary benefits as the petitioners are reported to be in-service candidates and to have been gainfully employed during the period in question. Needless to state that on their appointment, their seniority shall be fixed having regard to their merit position as per the selection list. In case of a tie, ie same merit secured by more than one candidates, rules occupying the field on the date the selection process was initiated shall be followed. Let the entire exercise be completed within four weeks," the court directed. (JNF) |
