Court directs SIT to fast track case, file latest status report in case of missing court file

JAMMU, Jan 24: In a case of missing of court file, CJM Jammu Amarjeet Singh Langeh while taking serious note on the investigation of SIT directed Special Investigating Team in the case shall fast track the investigation and ensure that latest report qua the status of the investigation is submitted by or before next date of hearing.
This significant order was passed by CJM Jammu in which the Senior Superintendent of Police, Jammu was asked to register FIR regarding misplacement of file no. 66/civil titled "Faquir Chand Vs. Karpal Singh" from record room, Jammu. Following this FIR 187/2014 was registered with Police Station Pacca Danga, Jammu for offence under section 409 of RPC.
The SHO of the concerned police station was also required to furnish fortnightly progress report in the investigation to this court. The CJM Jammu observed that record also shows that a SIT was constituted to investigate FIR in question which was headed by SDPO City (North), Jammu with SHO Police Station Pacca Danga, in-charge Police Post Panjtirthi and reader of SDPO supra as its members.
During investigation, various status reports were submitted. Vide report dated 18.10.2021 submitted by Sub-Divisional Police Officer, City, North- Jammu, it was conveyed that Special Investigating Team obtained a list of two officials who were deployed in the record room during period in question whose statements were also recorded under section 161 of Cr.P.C.
During investigation it came to the fore that file in question was sent to the office of Principal Sessions Judge, Jammu on 24-1-2007 in connection with some enquiry. The status report that then AO and SO administration are required to be questioned in connection with the whereabouts of the file.
The fact that FIR in question was directed to be registered on the direction of worthy Registrar Vigilance High Court of J&K and that too in 2014 per se gives the sense of gravity and seriousness of matter under investigation. Nothing is forthcoming in the status report aforementioned as to what prevents SIT from questioning the then AO and SO administration so as to unfold the mystery and to reach to real culprits.
