Govt reply says no Disturbed Area Act in place in J&K | | | Asif Iqbal Naik

Jammu, Mar 24 : The controversy over the revocation of Armed Forces Special Powers Act (AFSPA) further deepens today after the government in its reply to NC legislator Bashir Ahmed Veeri's resolution on revocation of "Disturbed Area Act" (DAA) stated that there was no such act in place in J&K after October 7, 1998 since it was put in place for only one year in 1997 and since then the act hasn't been revoked. The government stated that "This is to inform you that the Jammu and Kashmir Disturbed Area Act, 1997 was valid for only one year and has lapsed on 7th of October 1998", and added that "At present the Disturbed Area Act is not in force in the state. Therefore, the resolution submitted by you for revocation of Disturbed Area Act has been disallowed". Talking to Early Times, Dr Veeri said that according to section 3 of AFSPA, the DAA paves way for implementation of AFSPA in the state and added that in case there was no such DAA, the imposition of AFSPA in Jammu and Kashmir losses its legality. He said that after receiving the government reply, he raised the issue inside the legislative council but he was not allowed to speak and then he walked out in protest. He said he had also moved adjournment motion over the issue, but that too was disallowed. Talking to media persons, NC leader Mohammad Akbar Lone while accepting his party's mistake over its failure in revocation of AFSPA and DAA said that after the government reply it was clear that there was no DAA in Jammu and Kashmir and added that the onus is now on PDP to take the final call on DAA and revocation of AFSPA. PDP leader and Revenue Minister Javed Mustafa Mir refused to comment on the issue and said Chief Minister Mufti Mohammad Syed who is also Home Minister of Jammu and Kashmir is the right person to speak over the issue. It is pertinent to mention that J&K Disturbed Areas Act 1992 [Act No: 4 0f 1992], which was originally titled and enforced as Jammu and Kashmir Disturbed Areas Act 1990 [Governor';s Act No: 12 of 1990], and which gave special powers to police and other forces not covered under J&K AFSPA 1990, has lapsed on 7-10-1998. Successive governments of Dr. Farooq Abdullah, Mufti Mohammad Syed, Ghulam Nabi Azad, Governor N N Vohra and Omar Abdullah have not extended this law after 1998. |
