PIL on dilapidated roads, lack of civic amenities

Jammu, June 5: In a Public interest litigation filed by one Jasvinder Singh regarding dilapidated condition of roads which jeopardize the safety of the people and also infringe upon the rights of the citizens to have an access to safe roads, a division bench of Jammu and Kashmir high court comprising Justice Muzaffar Hussain Attar and Justice Janak Raj Kotwal has issued notices to the state government and its agencies through P.S.Chandel, Dy.A.G, seeking its response within three weeks.
Parveen Kapahi, Advocate appearing for the petitioners projected in the PIL that roads in various Districts of Jammu and Kashmir including rural areas are mostly in dilapidated condition. It is pleaded that there are pothole and ditches which are not properly leveled and surfaced. It is also pleaded that no foot ways and foot path exist and wherever they exist they are in poor condition and encroached upon.
It has been further pleaded that the proper technique in constructing and repairing of the roads is not being used and proper material has also not been used.
It is pleaded that the roads are being constructed and their maintenance is being done by spending tax payers' money. The counsel for the petitioner submitted that right lo have properly maintained roads is engrained in the fundamental right guaranteed under Article 21 of the Constitution.
The petition also raised issues of poor amenities including sanitation and drinking water facilities on which the government claims to have spent in crores, but have remained inadequate thus causing lot of inconvenience to the citizens.
The petition sought direction from the court that the Municipal Corporations must immediately repair roads in the cities of Jammu and Kashmir and also core areas within reasonable dispatch of time and undertaking before this Court that the said roads would be maintained in good shape free of potholes, ditches, trenches and smooth roads and lanes, so that the common man may not suffer.
A direction may be issued to some independent agency to enquire into the State of affairs which resulted in non maintenance of proper roads and Lanes and by lanes and also sewerage system which is not workable at all and huge funds has been spent at the disposal of concerned agency and the funds are not being utilized properly or same are misused by the functionary of the Government on their own or any other appropriate order may kindly be passed keeping in the interest of the general public.
