| U N Security Council should look over violation commits Pakistan for altering Status quo of Indian State of Jammu & Kashmir | | | A N Bharadwaj | 7/24/2015 10:12:16 PM |
| It is serious and noticeable for the U N Security Council that Pakistan is committing violations one after other in unbridled manner unwarrantedly to cede Indian State territory out of the status quo to China at the cost of Indian sovereignty to serve its political interests as well as change the demography of Gilgit Agency by uprooting the local people. There indigenous people belong to Shia faith are being harassed by using coercive methods to settle the alien people belonging to Sunni sect on their land resulting in erupting of sectarian violence and killings. The blood-spilling fighting shattered the social fabric of their community, which prevailed lawlessness and chaos. It under systematic clandestine plan eliminates the minorities of its country in brutal way that has been reduced from 14% to 1%, which is horrible. On the issue of demographic change of Gilgit Agency, Pak- occupied Indian State territory, the Director, Sering, Institute for Gilgit and Baltistan disclosed to media, at Press Club, Jammu, (J&K) dated 22nd April 2015, about Pak-determining policies to reduce the minorities of its country under intolerance of faith. The sexual assaults in day light, then conversion and after wards to marry with her forcibly are the daily feature, which is shameful for Pakistan. Under the circumstance, the U N Security Council has organizational mandate to look on the violation and ask Pakistan to restrain itself to commit for any unwarranted forward action of the status quo of Indian State territory. Its position is a care taker of that territory to keep it in original position. In the back ground of its political character, the Pak-ruling leadership as per its habit first denies the violation and other offence, and later on admits the same highhandedness, it's that strategy is still continue. The Gilgit Agency is still an undeveloped territory. The people of the area are reeling in deep backwardness and quagmire of ignorance. They have no political rights, even deprived of from fundamental rights. The Government has not paid any attention towards their education, economical improvements. No initiative to improve the communication system and other developmental projects has been taken for the welfare of the people.
To cover its tilt and deep lopsided policies and lacuna in governance, the Pak-Foreign Secretary accused India on very flimsy grounds with remarks that it had changed the demography of Kashmir by settling non-State citizens in Jammu region resulting in chaos and destability. In fact, Pak-lobby working in Kashmir to implement its agenda, slaughtered en masse Kashmiri Hindus in very brutal manner and some four lakhs who saved their lives were thrown away from their ancestral places violently, who migrated to India, their properties were set on fine, committed loot and plunder, sexual assaults , rape, their conversion to marry with her, no one come for their rescue, and reduced the from 16% to 2% which was horrible. The influx of their migration created a serious problem for India to rehabilitate them. That cruel and inhuman reference of demographic change made by valley based Pak-lobby on the behest of Pakistan is not available in any history of the world. In addition to it, the victims of Pak-hegemony, who migrated from Pak-west Punjab to nearby Jammu region of Jammu & Kashmir State during partition of British India in 1947are still wandering hither and thither for rehabilitation and are being embarrassed for not granting citizen rights resulting in liquidation in their future prospects. The protests are made and demonstrations organized after every short interval to assimilate in the society, but their lamentable voice is unheard. It is the facts of the events, but aggressor Pakistan pleads baseless and concocted propaganda on flimsy grounds to mislead international community, which can be verified through any impartial agency.
o Terror Pakistan is not supposed to interfere in the domestic affairs of India through the act of proxy war after defeating three conventional wars initiated over J&K State for its grabbing with its muscle power. On the other side Pakistan along with its stipendiary lobby established in the valley to implement its Kashmir grabbing agenda with a technique announced from God-house-mosque to create violence for subversive activities, indiscriminate killings to create fear, heinous crimes to bow down for its demand, attack on security forces for chaos, abduction, sexual assaults, rape, loot and plunder for creating unrest and lawlessness after wards to defame India for human rights violations which is the foundation of its growth.
o Pakistan is under legal obligation as well as also under the sense of responsibility to keep the status quo in original position as a Care-taker asked by the U N Security Council. The political position of India over the State of Jammu & Kashmir is well known to the world. Its sovereignty had flown from His Highness the Maharaja Jammu & Kashmir State in favour of India under the spirit of Indian Independence Act of 1947and the proclamation of June 1947 of Viceroy of India of British Crown declared to the Chamber of Princes of British Indian States at New Delhi on June 1947, on the issue of empowering them to join either this or that dominion according to their choice, as well as the British Cabinet Mission memorandum dated 1946 about heir transfer of sovereign rights . In these legal documents no reference appears on the issue of their subjects i.e. the Rulers of their States of British India were full competent wholly and solely authority to take the merger decision of their States according their choice. Therefore in the light of British Government verdict, the All India Muslim League President M A Jinnah issued Fatwa (proclamation) for the Muslims of British Indian States before the 15-days of partition of British India to abide by the spirit of British Crown declaration. Accordingly, the subjects of these British India States were well competent to decide their fate to opt either to stay in India or migrate to Pakistan as their citizens.
In the light of these glaring historical and legal facts, Pakistan has no right in any angle to exercise his political power in status quo of grabbing India State territory for its national interest or to cede any part out of the status quo to China whimsically for its political and economical advantage at the cost of Indian sovereignty without taking in to confidence neither U N Security Council which had appointed it as a Care-taker for the status quo nor India before altering Indian sovereignty, which violation was very serious to the extent to bleed South Asia.
It is an ironical to conduct election in the status quo territory of Indian State grabbing territory where Pakistan is a care-taker or Receiver only to keep the status of territory Intact and where it has no sovereign rights over that territory to bargain or cede or alter physically, or process for demographic change is a clear violation and deceit of trust as well as a direct challenge to marginalize the commanding status of the authorities of the U N Security Council. In the light of these changes in status quo under so called Gilgit- Baltistan empowerment & self-government is an attempt to camouflage its forcible and legal occupation of region where Pak-had already granted same provincial status for that region in 2009 under the pretext to find a solution in Kashmir issue on the basis of existing boundary but the boundaries of the territory cannot be altered without the sovereign rights of the country which would not be snatched in any circumstances. In continuation the violations after violations, Pak-rulers divided the Gilgit Agency measuring 85893- sq Km on their own in to two separate administrational divisions i.e. Mirpur-Muzaffrabad so called Azad Kashmir, which was earlier referred to by it as a Northern Area, which is a shaksam valley around about 5180 sq Km, ceded to China by them illegally in 1963, under so called self styled Border agreement, which was illegal transaction; because of the status of Pak-rulers is a Care-taker or Receiver, who is supposed to discharge his responsibility as directed by the employer, but they have no any political, sovereign, paramount rights to use the status quo whimsically. Pakistan presumes that it has paramount power with political supreme authority to use the status quo territory according to its choice, therefore under that presumption, it converted that territory in to a hub of terrorism where tourists are killed and the people belonging to other faith are rooted out all together. Its unbridle violations on different issues give impression of living in free world without any rule and law and is all round free to commit any violation for which it desires. Now, it is up to the UN Security Council to look on these unwarranted encroachments committed against the status quo territory in its whimsical self-rule. The world people are in wait about to know the action taken by it to restrain Pakistan with the instructions to keep regard of limit of its status of the status quo territory. |
