Lawyer ditches RTI applicant | Takes Rs 2000 for putting PIO on notice? | | Early Times Report
Srinagar Aug 9: For the first time since the RTI Act came into force in Jammu Kashmir, a lawyer from North Kashmir's Tangmarg area has taken Rs 2000 from an RTI applicant wherein he was assured of help for speedy disposal of his application filed before Block Medical Officer (BMO) Tangmarg who also happens to be the designated Public Information Officer PIO). The lawyer who is a practising advocate at Munsiff Court Tangmarg sent a legal notice to Block Medical Officer (BMO)Tangmarg as she failed to dispose off an RTI application within stipulated time. The lawyer instead of assisting his client to file first appeal before First Appellate Authority (FAA) ie Director Health Kashmir, charged him an amount of Rs 2000 to draft a one page notice. Details and copy of notice which is available with Early Times reveals that Shakeel Ahmad Bhat a resident of village Treran in Tangmarg wanted to get some information related to hospital development funds (HDF) of SDH Tangmarg under State RTI Act from the office of BMO Tangrmarg . The BMO made unnecessary delay and this forced the ignorant villager (RTI applicant ) to take lawyers assistance. The lawyer instead of helping his client to file the first appeal before Director Health Services Kashmir ( the designated First Appellate Authority) prepared a one page notice and send the same to BMO. For preparing this notice , the lawyer charged Rs 2000 from the poor villager. " It is a matter of serious concern that a law degree holder and a practising lawyer is not familiar with J&K Right to Information Act (RTI) . Even if he was not familiar , he should have gone through the J&K RTI Act 2009 and guided his client accordingly " said Shahid Ahmad a legal expert |
