Non implementation of Sp Tribunal order: SIC summons revenue officials | | | Early Times Report Jammu, Sept 20: As Tehsildar R S Pura failed to dispose off an RTI plea related to non implementation of the order of J&K Special Tribunal, the State Information Commission (SIC) summoned the officials of revenue department (Tehsildars) during the second appeal hearing here recently. Details available with Early Times reveal that one Surkhi Ram, S/o Durga Dass, a resident of Ward No. 10, R.S. Pura, Jammu moved an application dated: 21.04.2015 before the Sub Divisional Magistrate (SDM), R.S. Pura under the J&K RTI Act 2009 wherein the applicant seeking to know Whether the order of J&K Special Tribunal (File No. STJ/322/2013 dated: 06.03.2015) has been received in your office dated: 13.03.2015 If received; Cause of not delivering possession as per order passed by the then Tehsildar dated: 15.06.2005 No. 249. As Hon'ble Court of Special Tribunal has upheld the order; Who is officer responsible for not implementing it? The SDM, R.S. Pura transferred the application of the information seeker to Tehsildar, R.S. Pura and Tehsildar, Suchetgarh vide office No. SDM/RTI/463-65 dated: 01.05.2015 with a direction to provide the information to the applicant directly under intimation to his office. However, feeling aggrieved of inaction on the part of Tehsildar, R.S. Pura, the appellant filed an appeal before the First Appellate Authority (FAA) i.e. District Magistrate, Jammu. The First Appellate Authority disposed of the appeal vide Order No. DCJ/FAA/RTI/2015-16/74-75 dated: 14.07.2015 with the direction to SDM, R.S. Pura to fix the responsibility for non-implementing the order of J&K Special Tribunal Court on Tehsildars posted in R S Pura and Suchetgrah . The appellant having received no response from SDM, R.S. Pura filed 2nd appeal. However, the appellant during his hearing at SIC Jammu submitted that the delay on the part of then Tehsildar, R.S. Pura is not implementing the particular order of J&K Special Tribunal dated: 06.03.2015 is a deliberate act for conferring the benefit on the opposite party/respondents. The appellant also apprised the Commission that now the matter is pending before the Hon'ble High Court and status-quo has been maintained. SIC's in its order ruled, "The issue raised by the appellant relates to redressal of his grievance i.e. non-implementation of the order dated: 06.03.2015 passed by J&K Special Tribunal, Jammu. The appellant is advised to approach the appropriate forum for that. However, information as per office record stands already furnished to the appellant by the Tehsildar, R.S. Pura and as such no further direction in the matter is required. Tehsildar, R.S. Pura also explained the delay in furnishing the information to the information seeker which has been due to frequent transfers of Tehsildars of R.S. Pura Tehsil. The present incumbent, Abhishake Abrol, Tehsildar, R.S. Pura vide reference No. RSP/OQ/2015-16/842-44 dated: 13.08.2015 (02.09.2015) submitted that three of his predecessors have been transferred frequently since April, 2015 to August, 2015 and he has taken over the office very recently (i.e. 11.08.2015). From the aforesaid facts, it appears that there is no intentional delay or malafide on the part of Tehsildar, R.S. Pura in furnishing the information to the information seeker and it is purely circumstantial and have been caused due to frequent transfers of Tehsildars in the office of Tehsil R.S.Pura". |
