CIC criticizes previous Govt for repealing RTI Rules | | | Early Times Report New Delhi, Oct 18: The State Chief Information Commissioner (CIC) G R Sufi criticized the previous Government in Jammu & Kashmir for repealing J&K RTI Rules 2010 which gave enough autonomy to the State Information Commission (SIC) constituted under Jammu Kashmir RTI Act 2009. While addressing the annual convention of Central Information Commission in New Delhi Mr. Sufi on Saturday gave a detailed talk on the implementation of RTI Act in J&K. He said that it was so unfortunate that previous Government repealed the RTI Rules in 2012 which curtailed the powers of State Information Commission (SIC). He urged upon the present Government to look into this issue and ensure restoration of RTI rules of 2010. Among others Justice A P Shah former Chief Justice of Delhi High Court , Prof Madhav Menon , Wajahat Habibullah , Secretary DoPT , Secretary IT , Chairman of Telecom Regulatory Authority of India (TRAI) , CMD Air India spoke on the occasion. Prime Minister had inaugurated the convention on Friday. During his inaugural address Prime Minister had stressed for pro active and voluntary disclosure of information. This statement has send a strong message to the Government officials that there should be no compromise over the effective implementation of Right to Information Act (RTI). Prime Minister said that Government officials must change their mindset and ensure effective dissemination of Information for people. He said citizens particularly the ordinary citizens of country should be provided information without any delaying tactics by the Govt officials. The statement of Prime Minister has come at time when the vested interested people are trying to dilute the Right to Information (RTI) across country. In J&K State previous Government also diluted the RTI rules by amending them during September 2012 and since then they haven't been restored by the present Government. Pertinent to mention that in J&K State RTI Act was enacted on March 20, 2009 but even after a lapse of 6 yrs the Government departments have miserably failed to make voluntarily disclosure of information about which Prime Minister also stressed. Under section 4 (1) (b) all the Public Authorities which includes Government departments , semi Government departments , corporations , boards ,councils etc have to make proactive disclosure of all official orders, circulars , notices etc so that such information is readily available in the public domain through the official Government websites , notice boards ,sign boards etc and people need not to seek such information under RTI Act. As per J&K RTI Act 2009 the proactive disclosure was to be made within four months (120 days) of the enactment of the State RTI Act . The J&K RTI Act was enacted on March 20th 2009 and the Government should have made the voluntary / suo moto disclosures by the end of July 2009 but even till date the 80 % of the Government departments , boards , corporations , semi Government department's etc haven't done so which is a clear violation of J&K RTI Act 2009. Information Commissioners Prof S K Sharma and Nazir Ahmad also attended the CIC convention in Delhi. |
