CIC pulls up top police officials; IGP, SSP, DySP eat humble pie

Jammu, Oct 22: Three senior police officers of Jammu and Kashmir Police including IGP(CIV) PHQ ,SSP AIG and DySP DDP in ZPHQ who happen to be the FAA ,PIO DG HQs and PIO ZPHQ respectively ate humble pie at the hands of the Chief Information Commissioner following their refusal to provide the information on Standard Operating Procedures (SOPs) on the plea that it would "prejudicially affect the sovereignty and integrity of India.
The SOP is nothing but detailed "do's and don'ts" of the standard operating procedures for the armed forces and such guidelines were important and an effective check on the use/misuse of the power.
The CIC reprimanded the top officials after one Khurram Parvez who sought information related to the SOPs knocked the door of the Commission after the refusal on the part of the PIO and same was withheld by the First Appealate Authority (FAA).
"The PIO has not given any explanation with regard to what part of the information is hit under section 8(1)(a). Section 8(1) (a) refers to "sovereignty and integrity of India and security strategic, scientific or economic interests-----". No explanation is given which of these elements lead to the denial of information. It has further been argued that the provisions of Section 8(2) of the J&K RTI Act, 2009 envisages the need for disclosure of information being overwhelmingly in public interest", Commission satirically said.
Further, the refusal by the police officers was made when already Government of India had provided the information on SOP to the information seeker. "If the Government of India can provide the information about SOP then why can't the State Government do the same."
The Commission pulled police officers during the hearing the Commission further said that the police officers should update their selves before dealing with RTI queries.
