Challenging of JMC's demolition notice by ex-revenue minister | 'Whistleblower' seeks his impleadment in petition | | Early Times Report
Jammu, Jan 15: The petition filed by a former revenue minister in the state high court, challenging the JMC demolition notice, today took a new turn when the 'whistleblower' filed a Miscellaneous Petition (MP) in the court, seeking his impleadment in the petition. In the impleadment application, he submitted that he was fighting corruption at higher places and had approached JMC PIO, soliciting the information to the effect as to what action was initiated by the corporation with regard to the major violations of the approved building plan by the former revenue minister while raising the construction of his residential house at Deeli here. The PIO, vide No JMC/S/RTI/1345 dated November 17, 2015, disclosed that no action had been taken against him. He alleged in his MP that in view of the JMC's shielding approach, he filed a petition on November 30, 2015 (OWP No.1794/2015) wherein he sought directions to the JMC commissioner to perform her statutory duties under J&K Control of Building Operation Act, 1988 by initiating appropriate action against the ex-minister who had raised 1724 sft illegal construction at first floor and 1134 sft at ground floor of his residential house in violation of the approved plan. The applicant also sought an inquiry and registration of FIR under section 5(2) P C Act against the JMC's Khilafwarzi Wing which remained remiss in reporting the violations of the approved plan in time and defaulted to take action against the former minister. In the miscellaneous petition, it is also stated that despite the pendency of the petition filed by him, the ex-minister filed a fresh writ petition, challenging demolition notice without impleading him as a party respondent and the writ petition filed by him was not maintainable and was liable to be dismissed. He submitted that being whistleblower he was a necessary party in the writ petition and it was only he who got JMC activated and for the just and effective disposal of the petition he was required to be arrayed as party respondent. In the MP, he alleged that the petition filed by the ex-minister was an abuse of process of law as appeal against the demolition notice was sub-judice and further the high court was also seized of the writ petition filed by him in which directions were issued by the court on December 3, 2015 which led to the issuance of the demolition notice to the ex-minister. He prayed for his impleadment as party respondent.JNF |
