Jammu, Jan 15 Third Additional Sessions Judge, Jammu, Kishore Kumar has rejected the bail application of an accused who is alleged have kidnapped and raped a minor.
Khadam Hussain S/o Mohd Sharief R/o Ranjari Mohra, Rahya, Tehsil Vijaypur, District Samba who was allegedly involved in kidnapping and rape with minor.
Lal Din, son of Nizam Din filed a written complaint with Arnia police station on November 10, 2015, stating therein that on October 31, 2015 when he and his wife returned home after visiting a doctor at Ramgarh, her daughter was not at home.
When they searched for her, they came to know that one Khadam Hussain, son of Mohammad Sharief of Ranjari Mohra, Raya near Vaijaypur, had kidnapped her in his vehicle and kept her at some unknown place.
He alleged that Khadam "sells girls and is a very dangerous person. On his complaint, FIR No 75/2015 for offences under sections 363 and 341 of RPC was registered and during the course of investigation, police recovered the girl from the possession of accused and also arrested him. The girl was also got medically examined. Her statement and that of her father were recorded under section 164-A of Cr.P.C. and as per investigation, a case under sections 376 and 109 was registered.
The court, after hearing both the sides, observed that there was increase in the gravity of the offence of rape, molestation etc.
With these observations, the court rejected the bail application of the accused. (JNF)
