CJM orders probe against DySP for custodial torture of CRPF jawan

Jammu, Mar 26: Acting on a complaint filed by a Central Reserve Police Force (CRPF) constable wherein he alleged that he was unlawfully arrested and subjected to custodial torture on March 22, the Chief Judicial Magistrate (CJM) Kathua has ordered an inquiry against the Probationer Deputy Superintendent of Police (DySP) posted as Station House Officer (SHO), Kathua.
The CJM has forwarded the complaint to Additional SP Kathua Khalil Ahmed Poswal who has been entrusted to inquire into the matter and directed to report it within two days while being asked to put up the same on March 28.
It is pertinent to mention here that in an open display of highhandedness, the Probationer DySP Mohammad Idrees, at present posted as SHO Kathua, mercilessly had beaten up a CRPF jawan identified as Hurmat Singh, 34, son of Mulkh Raj of village Chainpura, Dhanni Bakhta, Tehsil & District Kathua, who is presently posted at Katra and currently on leave from his job, for merely parking his motorcycle allegedly wrongfully.
The DySP along with his PSO Gian, driver Neelam and two other police personnel, PSOs' to SHO Kathua, whose names are not known, took Hurmat Singh to the Police Station where he was allegedly tortured ruthlessly by all of them.
The complainant Hurmat Singh in his complaint stated that on March 22 at about 1:00 pm, he along with his wife Jyoti Devi visited District Hospital Kathua. The complainant dropped his wife there from where he went to SBI ATM near District Court Complex, Kathua for withdrawing cash. He temporarily halted his motor cycle bearing No. PB35 M 5490 near the SBI ATM and went inside for withdrawing cash. After taking cash from ATM he went to the nearby Photostat shop to photocopy some documents.
After completing the chorus, the CRPF jawan when about to start his motor cycle, the Probationer DySP along with his three PSOs and one Driver stopped the complainant to move further and asked him to show the original documents of the motor cycle upon which he produced the original Driving License, original Registration Certificate and other valid documents and handed over the same to the police officer.
Meanwhile, the DySP started to abuse the complainant and asked him why he halted his motorcycle there? The complainant politely told him that many people have also parked their respective vehicles here so he also halted his motorcycle just for few minutes.
The DySP then tried to snatch the key of motorcycle from the hand of the complainant which was resisted by the latter and asked for the reason of snatching the key of his motor cycle.
Instead of replying to the complainant, the DySP angrily ordered his all PSOs to arrest the complainant. The complainant asked them that why they are arresting him? On hearing this, the DySP slapped the complainant and also used filthy language in the full public gaze. His three PSOs started beating the complainant with fists and blows and forcibly put the complainant in the police van and took him to the Police Station, Kathua. On reaching the Police Station, the complainant was again beaten up with the open use of fists, blows and filthy language against him.
The complainant when approached Additional SP, Kathua on March 24 and narrated the entire incident to him, the senior police officer showed his helplessness to take any cognizance in this regard.
Due to the severe beating, the complainant is in a State of shock and his hearing capacity has been impaired from normal.
The complaint was lodged under sections 220/290/323/330/336/341/342/352/357/506/34 of Ranbir Penal Code (RPC).
