Early Times Report Jammu, Apr 1: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan, while allowing a writ petition filed by an ETT Institute of Kathua and others, today directed Board of School Education (BOSE) to accept the list of students of management quota for the session 2011-2013, if they were admitted as per the sanctioned management quota. The petitioner's counsels argued that after the government, vide order No 452-Education of August 10, 2011 issued calendar for various events for controlling and regulating ETT course, the petitioner's institution applied within the stipulated time after depositing the requisite fee of Rs 25,000, but the respondents did not adhere to the calendar. Hence another notification was issued in which NOCs were to be submitted by November 16, 2011 for consideration. It was argued that the petitioner's institution submitted NOCs prior to the date fixed for their issuance. So, the board published a list of affiliated colleges to run ETT course in which the names of petitioner's colleges were mentioned. The petitioner's colleges also deposited Rs 9,240. It was pleaded that another notification was issued on August 8, 2012 and directions were issued to the colleges to submit a list of management quota along with requisite fee by August 18, 2012. The petitioner's institution on August 14, 2012 approached the respondents along with NOCs and requested to accept the list of management quota as well as the requisite fee. The bench, while allowing the petition, held that it was an accepted principle of law that the admissions of students, having been admitted for the session 2011-2013 for undergoing courses after the grant of affiliation order by the board for that period, were to be approved if they were admitted within the sanctioned management quota. |
