Complainant proves 'wrong' DC's claim, submits Chuwadi's Aks Masavi in court | If it a fact, DC appears to be lying: Court | | Early Times Report
Jammu, May 24: There was really an embarrassing situation for the Deputy Commissioner (DC), Jammu, in the court of special judge, anti-corruption, A K Koul today when proving wrong his claim that Aks Masavi of Chuwadi was not available with revenue authorities, the complainant submitted a copy of it to the court. The judge also passed strictures against the DC and Vigilance Organisation, Jammu (VOJ) for their failure to complete probe in the alleged encroachment of a nallah and government land near a petrol pump at Sunjwan. The complainant, who appeared in person, alleged encroachment of a nallah by a powerful land mafia with the active connivance of revenue officers and drew the court attention to the slow progress of VOJ inquiry. She also drew the court attention to a report of the DC. After perusal of the report, the judge observed that from the reports of DC and VOJ's inquiry officer, it appeared that things were not moving as they should have been. "Every officer appears to be passing the buck. The DC, in his report, has expressed helplessness in arriving at a definite conclusion and states that there is no Aks Masavi of Chuwadi available with revenue authorities. However, the complainant contended vehemently that Aks Masavi is very much available with revenue authorities but they are reluctant to say so for the reasons best known to them," the judge said. The complainant submitted to the court a copy of Aks Masavi of Chuwadi and stated that she had obtained it from revenue department. "On this, the judge said if it is a fact, DC appears to be lying," the judge said. It is pertinent to state that DC is asking the court for a direction to settlement officer (SO) to construct Aks Masavi of Khasra No 887. The court noted with concern that SO is subordinate to DC and instead of asking him to reconstruct Aks Masavi, he was seeking the court assistance. "Does it not sound strange? Should the court ask the revenue officers to do what they are otherwise obliged to do in a routine manner?" the judge said. "One is not in a position to understand as to what interest DC has in not coming out clear about what actually is the position on spot. So far as VOJ is concerned, it needs to be pointed out that earlier a recommendation was made for registration of FIR by then inquiry officer under section 5(1) (d) of P C Act read with section 120-B of RPC, but it could not be registered because some query was raised by DDP, VOJ, which lead to further protraction of the matter," the court observed. While lamenting the VOJ role, the judge said it was also seeking the court help in ascertaining the facts and so was the DC doing. "VOJ is sitting over the inquiry but is not in a position to conclude it. This reflects on the working of the system because instead of doing whatever is needful, to conclude the inquiry either way, VOJ appears to be expressing helplessness," he observed. The judge directed that a copy of Aks Masavi, produced by the complainant in the court, be forwarded to DC and he be asked to verify its genuineness and also explain as to why he has not been able to lay hands on it when the complainant can have it. The court also directed VOJ SSP that he be asked to report as to what the inquiry officer had been doing all along and what the VOJ proposed to do. There couldn't be two opinions about the fact that inquiry had to be concluded either way on its merits but why did VOJ feel shy in concluding it at the earliest, the court said. "Delay erodes faith in the system and court believes that VOJ will take up an appropriate action as required under law to be done in the matter and finalise inquiry within the shortest possible time instead of seeking the court assistance in concluding it," the court said.
