HC directive to consider claim of medicos for regularisation | | | Early Times Report Jammu, July 14: First puisine judge of high court, Justice Ramalingam Sudhakar today directed respondents to consider the claim of petitioners for their regularisation from the date they were appointed as deputy medical superintendents in case they satisfy the eligibility criteria. The court directive came in a petition filed by Dr Ramesh Gupta, Dr Harbans Lal Sharma and Dr Ravinder Rattanpal, seeking regularisation of their services as deputy Medical Superintendents in the Medical Education Department on the analogy of Dr Jasbir Singh and Dr Rakesh Khajuria with effect from the date they were appointed as deputy Medical Superintendents. After hearing both the sides, Justice Sudhakar observed that if the petitioners were entitled for regularization in the Health Department and were to be promoted as Chief Medical Officers first, their cases should be considered at the threshold. Thereafter the question of deputation can be addressed. This anomaly should be removed by the government, he directed. Setting aside the impugned order, the court directed the official respondents to consider the claim of the petitioners for regularization, if they satisfy the eligibility criteria as per relevant rules. The Department will subject to the above thereafter consider promotion to the post of Chief Medical Officers as per rules as may be applicable. The petitioners, can thereafter be considered for appropriate post of either Medical Superintendents or other post in the Medical Education Department, as per their seniority and eligibility. With these observations, the court disposed of the petition. —JNF |
