HC directives over supply of essential commodities in Kashmir | | | Early Times Report
Jammu, July 20: In a PIL as regards the non-supply of essential commodities and shortage of medicines and life saving drugs in Kashmir due to curfew restrictions, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Muzaffar Hussain Attar today issued various directives. After hearing both the sides, the bench observed that as ordered by this court on July 18, 2016, the status reports were filed by the CAPD Director, Kashmir, and the Deputy Commissioners of Budgam, Anantnag, Shopian and Ganderbal districts. "In the status report of CAPD director, it is stated that in Sringar district, out of 400 sale centres, including Fair Price Shops and some centres functioning on internal adjustment basis, the sale of foodgrains has been conducted at 202 sale centres as on July 19 last. It is stated that almost all the storekeepers working in the department operate more than one ration depot, as such, sale of ration at all the ration depots simultaneously is not possible," the bench observed. It was also stated that residents of Habbakadal, through Intizamia Committee, informed that they would receive their quota of ration after the situation improved and as such no sale could be conducted in the said area. In so far as supply of LPG cylinders in Srinagar district was concerned, nothing was mentioned in the status report filed by the CAPD Director, the bench observed. In his status report the Anantnag DC stated that out of total allocation of 63914 quintals of rice, 24473 quintals had been made available to the sale outlets of the district and out of it, 21657 quintals had been distributed among the rationees up to July 18 last. In so far as supply of LPG cylinders in the district was concerned, no data was provided in the status report. The advocate general submitted that supplies would be ensured and the data would be provided in the status report to be filed on the next date of hearing. The Budgam DC, in his status report, stated that there was no shortage of ration in the district as of now and ration items were being made available to the consumers at their respective ration ghats. It was stated that foodgrains had been distributed to the rationees from July 5, 2016 and dispatching of further foodgrains to different sites had been restored from July 17. It was also stated that home delivery of LPG cylinders in the main towns of the district was made by the concerned agencies and in rural areas through point delivery of the concerned agencies. The Shopian DC stated that supply of ration items had been made through 19 centres and there was no dearth of sugar or kerosene oil in the district. It was also stated that 295 LPG cylinders had been distributed among the consumers in the district and delivery was made at homes in different villages on 17th and 18th July, 2016 and there was no shortage of LPG cylinders in the district. The Ganderbal DC stated that ration was being made available to consumers at their respective ration ghats and he had personally visited ration ghats of the district on July 17 last. It was also stated that there was no shortage of LPG or kerosene oil in the district. The advocate general submitted that ration depots in Kupwara district were functioning properly and there was no shortage of sugar which was being sold at the rate of Rs 13.50 per kg. He stated that dispatch of foodgrains from FCI, Kupwara, had been resumed and same was going on smoothly and the 42333 quintals of it had already been dispatched to sale centers. The bench observed that in the response filed by the petitioner today, it was acknowledged that a perceptible change in the distribution of essential commodities like ration was visible in the curfew- bound areas of Srinagar. However, some areas like Ziyarat Batamaloo, Dhobi Mohalla, Batamaloo, Kursoo Padshahi Bagh, Karfali Mohalla and maximum areas on the right and left of Nallamar Road, Srinagar, were required to be catered. It was submitted that some areas of Kulgam and Anantnag were still awaiting ration. Similarly, some areas in the districts of Pulwama and Shopian were required to be given attention. It was also acknowledged that availability of medicines and surgical equipments and patient care had improved. However, the supply of medicine of cancer patients registered in SKIMS was yet to be complied with, the bench observed. The advocate general submitted that a total of 2379 patients were registered with the SKIMS from 16 districts and several of them had visited the Institute for Kemotherapy and Radiotherapy. He assured that, as ordered by this court on July 18 last, cancer patients who were unable to visit the institute to collect medicines for a month would be supplied medicine through District Health Officers/officials and status report to that effect would be filed on the next date of hearing. The advocate general also submitted that that minor repairs and fixing of temporary CGI sheets were detected near Saidakadal and work had been stopped. Five FIRs had been registered against five persons and one person was trying to construct illegal roof over his house at Akhoon Mohalla near Habak which was demolished by Enforcement Wing of LAWDA headed by a DSP. No building material was being allowed to be transported in Boulevard area to stop violations and strict vigil was being maintained in the entire Dal area, he said. "Since another division bench is dealing with PIL No 159/2002 on the subject, we are not expressing our views in this order. However, the advocate general is directed to ensure implementation of the orders passed in the PIL regarding weeding as well preventing of encroachments and disallowing of building material in and around Dal lake and LAWDA authorities shall file a status report in the pending PIL on July 26, 2016. It was also noticed by the court that J&K Bank, having its ATMs in the entire valley, was not loading the ATMs to enable the account card holders to withdraw cash. Hence, the bench impleaded the bank's managing director, Corporate Office, M A Road, Srinagar, as a party respondent in this PIL so as to get the status report with regard to availability of cash in the ATMs as well as functioning of branch offices of the bank in the valley and directed the AG to communicate him this order.
