HC stays acquittal of rape-accused faith healer Gulzar ‘Peer’ | | | Early Times Report
Sringar, Mar 3: Nearly three weeks after a sessions court in Budgam acquitted self-styled faith-healer Gulzar Ahmed Bhat alias Gulzar Peer of the charges of rape, the J&K High Court today stayed the verdict and ordered police to take him into custody. A Division Bench of high court comprising Justice M H Attar and Ali Mohammad Magrey said, “In the normal course in acquittal appeal, Court does not pass interim order either for staying of the impugned judgment and for directing the arrest of the accused. However, after perusal of the statements of the prosecution witnesses, more particular of those girls (minors) who have been subjected to sexual assault, a very strong case is made out for issuance of interim directions.” “The victims (girls) who have been subjected to sexual assault have given graphic details in the manner they were trapped and subjected to sexual assault and the law and justice, both would require to ensure that accused does not give slip to law,” the division said and stayed the judgment of the sessions court. “In the interest of justice, we at this stage direct that, till further orders from the Court, the impugned judgement dated 12th February. 2015 passed by learned Sessions Judge Budgam in File No. 142/S in case FIR No. 40/2013 u/s 376. 109 RPC registered at Police Station. Khansahib shall stay to the extent of respondent no 1 (Gulzar Peer), the division bench observed and added, “the respondent no. 1 shall be taken into custody by the concerned police authorities and lodged in judicial custody.” “His (petitioner) judicial custody shall be regulated in accordance with law,” the division bench added. In the appeal filed through station house officer Khansahib, the government has demanded high court to aside the Judgment of Principal Session Court Budgam and convict the accused. The state has said that the accused were found involved in FIR No.40/2013 for offence under Section 376 and 109 RPC and as such were challaned before the court. However the trial court has acquitted the respondents-accused by observing that there is no material on record to connect accused with the commission of offence.” Pertinent to mention that 45-year-old fake faith healer was arrested on May 21, 2013 after four minor girl students studying at his shady seminary accused him of committing the abuses at the residential institute at Shamasabad in Khansahib area of the central Kashmir district. |
