Jammu, May 20: Justice, Tashi Rabstan J&K High Court Jammu Wing, issued notices to Shafat Noor Barlas, Secretary, Rural Development Department and Shakeel U Rehmaan, Secretary, Public Service Commission (PSC) and to file compliance in a contempt petition filed by one Rajesh Gupta, Executive Engineer, REW. The said contempt petition was filed by the concerned officer for non-implementation of Judgment passed by the High Court dtd 9/3/2015 passed in writ petition No. 1674 of 2013- which says "In view of the Affidavit filed by the Secretary to Govt. Rural Development Department, Civil Secretariat, J&K ; Petitioner, who is present in person, stated that he would feel satisfied in case the writ petition is disposed of with a direction to the respondents to consider the claim of the petitioner under rules."
Counsel for the respondents does not oppose the suggestion made by the petitioner. The petition is, accordingly disposed of with a direction to the respondents to consider the petitioner's claim as projected in the writ petition under rules and pass consideration order within a period of six weeks from the date a certified copy of this order is made available to the respondents.
Later petitioner Mr Gupta provided the copy of judgment dated 9-03-2015 with due receipt in the office of both the officers on 13-03-2015. Thereafter a legal notice was also served to both the officers with due receipt on 20-04-2015 to implement the said judgment but the officers for the reasons known to them preferred to sit on file in spite of implementing the judgment.
Court observed that this clearly speaks of the efficiency of the officers that how they harass the innocents & how they don't bother for the orders passed by the Courts. |
