Court orders stay on transfer of Masters Association Kishtwar President

Jammu, May 20: In a much publicized case of transfer of President Masters and Teachers Association Kishtwar, the single bench of Jammu and Kashmir High Court headed by Justice B S Walia order stay on his transfer on Medical grounds and fixed May 25th , 2015 to the respondents to submitted the objections in the case. As per the details available with "Early Times", after going through the petition filed by the petition Mehboob Qazi through his counsel wherein the petitioner stated that he is suffering from "Bronchial Asthma" and is on regular Medication and as per the certificate issued by the Chief Medical Officer, Kishtwar on behalf of the Medical Board, the petitioner has been advised to avoid cold climate conditions and strenuous work like long journey by foot and prayed the he may be retained at his present place of posting on account of his medical condition, Justice Walia issued the notice to the respondent state through the office of the Advocate General for 25th of May 2015.
Counsel of Mehbooba Qazi also submitted before the court that apart from Medical ground, keeping in view of 291 vacancies of Masters in District Kishtwar, respondent No. 4-Deputy Commissioner Kishtwar has recommended to the Director School Education Jammu to retain the petitioner at Kishtwar on account of having received training at Delhi and Mumbai from the Haj Committee of India and being responsible for organizing training to the Haj pilgrims for forth coming pilgrimage session besides at present the petitioner being the only trained person in the District, therefore the services of the petitioner amongst other masters being required for completion of examination and other formalities related to Centrally sponsored scheme of Saakshar Bharat Mission.
After going through the petition, the judge observed that "Meanwhile, the petitioner shall be allowed to continue at his present place of posting at DIET Kishtwar till next date of hearing and subjected to objections from the other side" read the order passed by Justice Walia in favor of the petition filed by Qazi. Qazi was tranfered from diet Kishtwar to HS Ind. Ramban on 11-05-2015.
It is pertinent to mention that the transfers of masters and teachers from Kishtwar by Director School Education Jammu has sparked a major controversy after political parties like Congress and National Conference accuses BJP of selective transfers on community bases.
