12 yrs on, Janbaaz JKP Inspectors promoted as DySps await regularization | Some have retired, few have passed away, Home Deptt unmoved | | Sumit Sharma Early Times Report jammu, May 20: Resentment is brewing within the Jammu and Kashmir Police as 500 inspectors who were promoted as DySPs from 2003 onwards are still struggling to get regularized. Home Department's debility to get them regularized has added to their miseries. However, expecting nothing from the Police Headquarters (PHQ), the aggrieved knocked the door of the court to get their due share. Around 500 inspectors were promoted to the rank of DySPs in Police Department since 2003 upto end of 2014 in their own pay and grade against clear vacancies. While according promotion, it was clearly mentioned in the promotion orders that they would be confirmed within six months but 12 years have passed they are still looking for department's consideration. The story doesn't end here, there are some police officers who have attained superannuation and a few of them have even passed away during these 12 years. Meanwhile, Jammu and Kashmir Home Department , has expressed its inability on various grounds. The Home Department in its report has said, "Although, the Home Department had earlier submitted a proposal for promotion of around 250 inspectors to DPC of PSC, however, the PSC desired to seek opinion of the department of Law, Justice and Parliamentary Affairs on the import of orders passed in the case of Anita Sharma. The matter was referred to the Department of Law, Justice and Parliamentary Affairs which did not initially favour proceedings ahead with the promotion process but later opined that the department can go ahead as per the opinion of Advocate General. For submission of proposal to the DPC of PSC for regularization of Inspectors as DySPs, the Home Department needs to have among other things an incumbency list of promotee DySPs on a particular date. Since the entire gamut of promotions made at the level of the Inspectors as also DySPs is under review in light of the judgments passed in the case of Anita Sharma, Ali Mohammad Shah and Sanjeev Kumar and there being possibility of postponement of date of promotion of promote officers both at Inspector and DySP level and this being a mammoth exercise right from the SI of 1979 to SP level, the Home Department has been constrained to wait and not to refer such a proposal to PSC as may become subject of review upon settlement of the aforesaid cases. The Home Department said the High Court vide its order dated 27.02.2015 passed in SP No 1671/2014 titled Kanwar Tanjeet Singh and others v/s State of J&K and others has disposed of the writ petition with the direction to the respondent to convene DPC so that consideration is accorded to petitioners and other eligible candidates promotion as DySP on substantive basis. The court had directed that the committee once convened shall consider the matter in light of the averments made in the petition, recommendations, if any made in favour of the petitioners. The exercise is to be completed within three months from the date of receipt of the copy of the order. The above order of the High Court is actively under consideration in the Home Department". |
