HC asks Govt to ensure private schools don't charge Sep, Oct fee in Valley | | | Early Times Report
Srinagar, July 8: The state high court today asked government to ensure that private schools do not charge fee for September and October last year until decided by a panel headed by a yet to be nominated retired judge of the court. Hearing a contempt application filed by aggrieved parents, a division bench of Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey also issued notice to president of Unaided Private Schools Coordination Committee G N War. As the application came up for hearing, the court asked the additional advocate general S A Naik whether the government has nominated retired judge of the court as chairman of the panel. On submissions by Naik that some time be granted to divulge the information, the court directed him to call Commissioner Secretary, Shalin Kabra, to appear in persons after lunch break. Subsequently, Kabra turned up and stated that process to nominating a retired judge as chairman of the committee has been initiated and within a shorter period, the chairman will be nominated. He also assured the court that a circular will be issued by the department, stating that fees for September and October will not allowed to be collected by the school managements unless cleared by the committee. Kabra also submitted that no school shall be allowed to increase fee and shall be made to charge it as was in August 2014 in consonance with the directions by the court. Following his submission, the court directed Kabra to file compliance report by producing the circular before it on July 14. "For purpose of nomination of the retired judge, you may take some more time," the court said. After last year's floods, the court issued directions to all the schools not to charge tuition fee and bus fee from the students for the months of September and October. And if any school has already charged the fee, the court had directed that the same may be adjusted in future months. While disposing of PIL, the court last month also directed school not to increase the tuition fee as well as bus fee and charge it as was vogue in August last year till it was decided by the panel. The PIL filed by parents body had also charged the schools of fleecing them by selling books, stationary, identity cards to the students by the respective schools at exorbitant costs. However, the counsel for the petitioner said that the management of the private schools not only started pressurizing the students to pay the fee for the two months but also enhanced the fee at exorbitant rates. Last year, taking note of the unprecedented flood situation, the high court issued order not to charge tuition fee and bus fare from the students for the September and October last year. Meanwhile, the joint director education department Abid Rashid Shah filed the affidavit, stating that an advertisement published in local daily was issued by the unaided private schools without his Knowledge and "with the malafide intent." "A perception is sought to be created in the advertisement that the deponent have given permission to charge fee for September and October. This is totally wrong, malafide and without my knowledge," he said. |
