J&K RTI Act: Why should PIO's take 30 days to provide one page info? | | |

Srinagar, July 18: While J&K RTI acts provides that a Public information officer should provide information sought under the Act to the seeker within maximum period of 30 days, the PIOs are misinterpreting the provision of the Act and withholding information which can be provided in a day for 30 days, against the very spirit of the Act. Section 7 of RTI Act ( State & central) guides an applicant about the disposal of RTI request by a Public Information Officer (PIO). If one keenly goes through all these sub sections one gets a clear cut picture about the whole process of disposal of RTI application by a Government office . Section 7 (1) of J&K RTI Act 2009 says that Public Information Officer (PIO) designated by Government, shall dispose off the application as expeditiously as possible , and in any case within 30 days of the receipt of the request. But during the last 10 years It has been observed that not even a single RTI case has been disposed off by the PIO in less than 30 days. "RTI information which has to be collected , prepared , typed , or to be obtained from any other office has to be provided within a period of 30 days by the PIO. RTI applicant cannot force an officer to provide this information within a week or ten days. But a PIO is grossly violating RTI Act if he dispatches information after 28 days or even on the 30th day when the said information is available in the office of the PIO" Shahid Ahmad a Srinagar based lawyer argues "Why shall a Govt officer / PIO wait for four weeks to send Information to RTI applicant who sometimes needs it urgently. Information such as BPL list , IAY list is already available with the concerned officers of Tehsil or CAPD department , but they still make an RTI applicant to wait for 30 days and even after thirty days the information provided is incomplete" said Mohammad Ramzan Khan RTI activist from Budgam. The basic aim of incorporating the term as expeditiously as possible in J&K RTI Act was to ensure fast disposal of RTI applications and not implementing this legal term is itself a violation of RTI law and State Information Commission must take a serious note of it.
