Jammu, Aug 5: 2nd Additional Sessions Judge Jammu MK Sharma today discharged one Janmeet Singh and framed charges u/s 304-A instead of 304 against Akshit Ganjoo and Romesh Chander and also granted bail to both the accused. 2nd Additional Sessions Judge Jammu M K Sharma after hearing both the sides in length observed that the offences disclosed against Akshit Ganjoo and Romesh Chander are punishable under sections 279/337/427/304-A/34 RPC and 112/184 M V Act, whereas, offences u/s 304/118/203 RPC are not disclosed. "The ingredients of offence u/s 336 RPC are covered u/s 337 RPC, so the offence u/s 336 RPC has merged into section 337 RPC and Akshit Ganjoo and Romesh Chander are accordingly discharged of offences punishable u/ss 304/336/118/203 RPC, whereas Janmeet Singh is discharged of all the offences of which he is charged, court said. The offences disclosed against Akshit Ganjoo and Romesh Chander are not exclusively triable by the Court of Sessions. The case is, therefore, transferred to the Court of CJM Jammu for trial in accordance with the procedure for trial of warrant cases instituted on police report. According to the case that the birthday celebration of Pranav Atri in the intervening night of 24/25 December, 2014 turned into mourning with death of Fahad Mir (hereinafter referred to as deceased) foster son of Farooq Khan (Retd) police official and Sr BJP leader. During the party deceased Fahad Mir and accused Akshit Ganjoo had some verbal dual which was diffused by other friends. After the party, the guests left the venue of the party in different vehicles I.e. deceased Fahad Mir, accused Janmeet Singh and PW Satyam Manmotra were in car 'Polo' bearing no.JK02BD-4133 driven by Manmeet Singh while accused Akshit Ganjoo was driving car 'BMW' bearing no.CH01AH-2111 with Pranav Atri, Mihir Pratap Singh and Sabhi Khawaja as occupants, whereas, car 'Figo' bearing no.JK02AV was being driven by Vishwas Anand. As per the prosecution case, the accused Akshit Ganjoo irked over brawl wanted to teach the deceased a lesson and he conspired and raced with the vehicle 'Polo' in which the deceased was sitting on the front seat and hit the 'Polo' with his 'BMW' from the back, causing accident as a result of which the deceased was thrown out of the vehicle, sustained injuries and died. It is further alleged that the accused Janmeet Singh had deliberately kept the window of 'Polo' car open so that when 'BMW' hits 'Polo', the deceased can fall down. The investigation culminated in filing of this final police report against the accused.(JNF) |
