Can 'toothless' SAC deliver justice? | | | Early Times Report
Srinagar, Oct 26: After remaining defunct for more than a year, the State Accountability Commission (SAC) has again been constituted recently. Eminent persons from judiciary have taken control of the Commission , but can it deliver without the amount autonomy of autonomy needed to do justice? There is severe dearth of staff at SAC and the Chairman / members have no powers to fill up these vacancies with the result the work at commission is getting seriously affected. "The SAC chairman cannot even purchase stationery without the consent of Law Secretary. Commission is fully dependent on Government, under these circumstances how can one expect total prudence from SAC"? says an official of SAC (name withheld) Details available with Early Times reveal that SAC has only one stenographer, the prosecution staff is also nowhere and this is making work of recently appointed members very difficult . The SAC has to be given financial and other autonomy otherwise we cannot expect justice from it. Pertinent to mention that Jammu and Kashmir State Accountability Commission (SAC) was constituted under provisions of J&K Accountability Commission Act, 2002. The mandate of State Accountability Commission (SAC) is to inquire into the grievances and allegations against public functionaries that includes Chief Minister, Ministers, MLA's, MLC's, Chairpersons of various commissions, boards, Vice Chancellors etc. Justice (retired) R P Sethi was appointed as first Chairman of SAC in 2006 but he resigned from the post of Chairman SAC as he alleged Government's interference in the functioning of the SAC. The commission remained headless for as many as four years. From the last one year SAC remained defunct after the retirement of Justice (retired) Y P Nargotra and Justice Hakeem Imtiyaz Hussain. After remaining defunct for one year, the State Accountability Commission (SAC) has become operational as the selection committee headed by Chief Minister Mufti Mohammad Sayeed recommended the name of Justice (retired) Bashir Ahmad Khan the former Chief Justice of J&K High Court as Chairman of SAC. Justice Khan was administered oath very recently by the Governor. In addition to Justice Khan Justice (retired) Bashir Ahmad Kirmani and Justice (retired) J P Singh (former Judges of J&K High Court) have been appointed as Members of the Accountability Commission. " People don't know how to file a complaint before SAC as the mandate of this commission is not known to common people, I would request Justice B A Khan Chairman of SAC to undertake awareness programmes across state so that people have better understanding about SAC Act. The Accountability Commission must involve civil society in its campaign against corruption" said Shahid Ahmad Ronga Advocate J&K High Court. |
