HC directs to list SAC matters on Nov 23 | | | Early Times Report Jammu, Nov 16 : A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat today directed the registry to list on November 23 next the bunch of petitions wherein the proceedings have been stayed out of the orders of State Accountability Commission (SAC). These petitions were listed before the bench today but due to the paucity of time these were not heard. It was submitted before the bench that SAC matters were pending in the court for the last seven to eight years and because of the stay orders obtained by various public functionaries. These matters of public interest were required to be heard at an early date. It was also submitted that another batch of SAC appeals against the single bench judgment wherein it was held that SAC did not have suo moto powers to try the cases was also listed today and these matters also warrant early hearing. The court was told that a full quorum was now available in SAC and because of the stay orders, the SAC functioning had come to a standstill. The counsel prayed for immediate listing of these matters. The advocate general submitted that these matters require thorough consideration and the same cannot be listed in the daily supplementary cause list as it needs sizable time and both the batches of petition should be heard separately. Looking into the seriousness of the matters, the bench directed the registry to list the SAC matters, wherein regular inquiries have been stayed or final recommendations have been stayed, on Monday, ie November 23, for final consideration. It is worthwhile to mention here that writ petitions were filed by former Deputy Chief Minister Mangat Ram Sharma, Former Minister Abdul Majid Wani, Former Chairperson Khem Lata Wakhloo, IAS officer Atal Dulloo, then Sunderbani police station SHO Jamrod Singh, then animal husbandry commissioner Mohammad Din and then Udhampur PWD (R&B) executive engineer Dharamveer Koul, challenging various SAC orders wherein it had made recommendations and initiated regular inquiries in some cases. |
