Jammu, Dec 4: Special Judge Anti-corruption Jammu (CBI Cases) Jammu Vinod Chatterji Koul today decided three cases of corruption of Gandharb Chand Rajgotra the then UDC/Cashier, Kendriya Vidyalaya (KV), Miran Sahib, Jammu, and awarded five years Rigorous imprisonment in each case and fine Rs 270000/-. Special Judge Anti-corruption Jammu (CBI Cases) Jammu Vinod Chatterji Koul after hearing K.S.Pathania, Special PP CBI for whereas Advocate Seema Sharma appearing for the accused person observed the prosecution has succeeded in establishing charges framed against accused beyond any reasonable doubt, therefore, for the reasons stated above accused is found guilty of offences punishable under sections 409, 477A RPC and 5(2) r/w 5(1)(c) of J & K Prevention of Corruption Act and is convicted accordingly. "Keeping in view the period of trial of 08 years as well as the age of the accused, the adequate sentence commensurate with the level of his guilt would be five years rigorous imprisonment on each count and a consolidated fine of Rs. 270000/-, court said. The prosecution case in brief is that information was received in CBI office Jammu wherein it was alleged that K K Azad while working as Principal in Kendriya Vidhyalaya, Miran Sahib, Jammu and G C Rajgotra while working as UDC in Kendriya Vidhyalaya Miran Sahib, Jammu during the year 2000 to 2002 dishonestly and fraudulently and by abusing their official position in conspiracy with each other committed offences of cheating and criminal breach of trust by way of collecting the amount from various teachers who collected fee on account of Vidyalaya Vikas Nidhi Fund etc from the students on different dates but did not deposit the entire amount so collected as per record in the Bank account of Kendriya Vidhyalaya Miran Sahib. |
