DB sets aside judgment of writ court over appointment of DySP 12/4/2015 11:48:49 PM Early Times Report Jammu, Dec 4: In two LPA filed by Muhammad Faisal Qureshi and State of J&K through its Chief Secretary against the judgment of writ Court whereby Writ Court quashed the appointment of Muhammad Faisal Qureshi as DySP, the Division Bench (DB) of the State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat set-aside the order of Single Judge in regard the quashing the appointment of DySP The Division Bench observed that the power of relaxation under Rule 5 of the J&K Classification, Control and Appeal Rules, 1956 is exercised by the Government, considering the meritorious and unblemished services of the appellant as mentioned above in the Army as well as in J&K Police. "It is not the case of the respondents that they are disputing the merit possessed by the appellant for appointing him permanently as Dy.SP in relaxation of rules, court observed and added in such circumstances, we (court) are of the view that the Single Judge has not considered the said aspects in its right perspective.
