Alleged encroachment of nullah by ex-revenue minister, others | HC directs JMC, UEED to file status report within 1 week | | Early Times Report
Jammu, Dec 14: High court judge B S Walia has directed JMC commissioner and UEED chief engineer to file reply as well as status report within one week of the July 28, 2015 representation of the petitioner, seeking removal of encroachments allegedly made by an ex-revenue minister and others on a nallah close to Satyam Resorts, Marble Market, that falls in village Deeli near here. The petitioner's counsel submitted that both JMC and UEED were acting as mute spectators and had been just passing bucks on each other and no action till date had been initiated against the former revenue minister solely for the reason that he was highly influential and officers of JMC and UEED were reluctant to take action against him. He said that since a big "shark" is involved, there is no headway in the matter otherwise directions were issued in this matter on September 3, 2015 to JMC and UEED to file the status of the petitioner's July 28, 2015 representation, seeking demolition of the encroachments raised by the ex-revenue minister and others near Satyam Resorts but till date the requisite status report had not been filed and today again more time was being sought to shield the alleged misdeeds of the accused. Resisting his arguments, the senior AAG sought further two weeks time to file the reply as well as the status report. The petitioner's counsel, however, opposed the AAG's demand and said already much time had been consumed by JMC and UEED. He strenuously argued that both JMC commissioner and UEED chief engineer be called in person before the court so that they be asked about the inaction on their part in the matter. After considering the submissions of the petitioner's counsel, Justice Walia put a query to the AAG as to whether the September 3, 2015 court order was delivered upon JMC and UEED for implementation. Upon this, the counsel replied in the affirmative, saying it was submitted on court direction on September 10, 2015 and also produced the receipts of the registered posts that were sent to the two departments. After going through the receipts, Justice Walia expressed displeasure over the lackadaisical approach of JMC and UEED and looking into the public interest involved in the matter directed the senior AAG to come forward with the reply as well as the status report within one week. Justice Walia also directed the registry to list this petition higher-up in the cause list in the week commencing December 21, 2015. The court also directed the petitioner's counsel to place on record the copies of the postal receipts as well as the communication dated September 10, 2015 served upon JMC and UEED for implementation of the court order by moving a proper application. --(JNF) |
