SSRB takes RTI casually : CIC | Penalty notice issued against Sr Law Officer | | Early Times Report
Jammu, Jan 23 : The Services Selection Recruitment Board (SSRB) has again violated Right to Information Act (RTI) by denying copies of type test report to an aggrieved unemployed youth. Taking matter seriously the State Chief Information Commissioner (CIC) has now issued penalty notice against the Senior Law Officer who has been found guilty of withholding the information. The CIC in his order said that SSRB officials take RTI casually and do not adhere to the provisions of the RTI Act. Details available with Early Times reveal that one Sunil Kumar Bhat, a resident Jagti Nagrota filed an RTI application before the PIO of SSRB, on 12.08.2015 seeking complete cut point details along with Xerox copy of typing test report under serial No: 446 Jmu 114 with Bar Code No. 335368. The Administrative Officer who is also designated PIO SSRB transferred the RTI application to Sr. Law Officer, Central Office vide his letter No: SSB/Div/J/290/RTI/2015/643- 45 dated: 22.08.2015 and requested him to provide the information directly to the information seeker. But officials failed to respond and aggrieved information seeker filed first appeal before the Secretary SSRB who is also the First Appellate Authority (FAA) on 12.10.2015. Having not received any response from the FAA and PIO, the appellant filed second appeal before the State Information Commission (SIC) on 17.12.2015. The hearing was fixed on 14.1.2016. Both the PIO(s) of SSRB Adm Officer and Sr Law Officer attended. The appellant also attended. The Commission heard both the parties. During the course of hearing, the Commission was informed by Javeed Ahmed (Sr Law Officer) also PIO that he has not received any letter from Adm Officer ie PIO of Jammu office of SSRB. The PIO of central office (Adm Officer) rebutted and produced before the Commission the communication made with Javeed Ahmad PIO of Central Office. The Commission (SIC) noted with great dismay that the officers in SSRB are taking the RTI Act very casually and they don't adhere to the provisions of the J&K State RTI Act seriously. During hearing, SIC directed the PIO(s) to produce evidence before this Commission and the hearing was fixed for 15.1.2016 at 2.00 P.M. CIC's order reads: "Accordingly, both the parties attended hearing on 15.1.2016. PIO Central office Shri Javeed Ahmed has admitted of having received the letter from PIO Central office of SSRB and played the blame game in his communication dated: 14.01.2016. During the hearing the appellant was provided a copy of the information which he stated is not as per the RTI application filed by him. Commission is of the considered view that the information has not been provided to the appellant within the period stipulated under the provisions of J&K State RTI Act, 2009 and has cause a delay of nearly four months. Therefore, Sr. law Officer-cum-PIO SSRB Shri Javeed Ahmad is directed to explain why penalty proceedings under section 17 of the J&K State RTI Act, 2009 may not be initiated against him. His reply, if any, must reach this Commission within 15 days from the receipt of this order. Further PIO SSRB is directed to provide the information to the appellant within 15 days as per his RTI application filed before the PIO. Appellant is advised to inform the Commission whether he received the information from the PIO as per directions of the Commission and if not he is free to file complaint under section 15 of J&K State RTI Act, 2009 in this Commission. With these observations and directions appeal is disposed of" |
