Akshay Azad Early Times Report jammu, Mar 22: The promotions of Agriculture employees of various cadre posts have come under scanner, with employees alleging that Departmental Promotion Committee (DPC) was conducted in violation and manipulation of High Court stay order by department. An official of Jammu and Kashmir Public Service Commission (JKPSC) pleading anonymity said that the DPC of the Agriculture department was completed in the month of January. "Minutes of DPC meeting are already approved by the Committee", the official said, adding that the recommendations of the Committee are yet to be forwarded by JKPSC to the Agriculture department. On being asked about the stay of High Court, the official said that they had taken legal opinion of Law department, which in turn had clarified that there was no hindrance to conduct DPC. "On the legal opinion of Law department, DPC was conducted", he said. Contesting the claims of JKPSC, gazetted officers of Agriculture Production department informed Early Times that Justice Tashi Rabastan of Srinagar wing of Jammu and Kashmir High Court on 13/10/2015 had pronounced the order in case titled Mohammad Qasim Gani and others v/s State and others in SWP no. 2242/2015, Caveat no. 1455/2015, caveat no. 1461/2015. The order reads as, "Notice waved by B.A Tak learned advocate and Sajjad Ahmed Mir learned Dy. AG seeks and is granted one weeks time to file detailed reply. List in week commencing from 20 October 2015, till then no further promotion shall be made". Moreover, in a recent order on 14/3/2016, in SWP number 2242/2015 in case titled Mohammad Qasim Gani and others v/s State and others, the order pronounced by Justice Muzzafar Hussain Attar reads, "Registry to take steps for listing of the case along with SWP no. 209/2014, 1336/2014, 1434/2014, 2140/2014, before some other Bench in week following the next. Interim direction to continue till next date before the Bench, Higher up". The officer informed that according to these judgments, it became explicitly clear that High Court had stayed further promotions, but it was very unfortunate that Departmental Promotion Committee (DPC) was conducted by Agriculture department, which was also contempt of High Court orders. "It was only done to help some blue eyed officials of department", they claimed. Criticizing the Agriculture as well as Law department, the officers claimed that it was very unfortunate for a system of rules, as Government departments were themselves indulging in violation of laws and HC directions, to illegally uphold interests of some blue-eyed officials. |
