Sale on Loose cigarettes: HC asks govt to file response within two weeks | | | Early Times Report
srinagar, Apr 12 :A Division Bench of the high court comprising Justice MH Attar and Justice J R Kotwal today issued notice to government on a Public Interest Litigation (PIL) seeking details about steps taken by it for banning the sale of loose cigarettes and other tobacco products. Issuing the notice, a Division Bench of the court comprising Justice MH Attar and Justice J R Kotwal directed government to file the response within a period of two weeks. The PIL has been filed by one Mohammad Altaf Dar, a resident of Budgam in central Kashmir. The petitioner said that the state of Jammu and Kashmir is emerging as smoking capital of Northern India and smoking is almost double the nationwide prevalence as the state has 12% of cigarette smokers as compared to the nationwide prevalence of 5.7%. he said it has also came to light that highest proportion of Adults, 67.9% ,are exposed to tobacco smoking in offices. "The loose cigarette is mostly sold to younger generations who cannot afford a full package of cigarette or tobacco, petitioner submitted to court and added, "on one side it violates the section 7 of the Act as without warning and on other side it plays havocs with the health of the young people including school going children." He said that the states like Punjab, U.P, Maharashtra and Himachal Pradesh have already issued notifications to ban sale of loose cigarettes and tobacco in order to plug the loop holes in the Act. |
