Handwara girl, father sought protective custody: Police | HC issues notice to Govt on PIL seeking probe by sitting judge | | Early Times Report Srinagar, Apr 20: Police today out rightly rejected claims by a woman, saying her 16-year-old daughter and husband were detained by Handwara police and said that they sought protective custody following massive protests in north Kashmir town last week. The police submitted a status report including the statement of the girl and the father recorded before the Judicial Magistrate of Handwara last week. The girl had denied that she was molested by a soldier but her mother filed a petition that she along with her father were detained by police and the statement recorded in a video was extracted out of coercion. In her petition, she had also sought release of her daughter and husband who police said were in 'protective' police custody. In the status report, the police said that the girl approached police station Handwara on April 12 at about 3:15 pm with a grievance that she was molested, dragged and slapped by two local boys while she was coming out of a public lavatory in the main chowk Handwara and that and this act defiled her modesty. Accordingly a case vide FIR No. 130/2016 u/s 509, 354,341 RPC was registered in Police Station Handwara, it said. "Meanwhile, some subversive elements raised hue and cry in town Handwara alleging that an army personnel had forcibly molested a minor school girl in a public lavatory. This incited/provoked the locals and the news spread like wild fire in the whole Handwara town. The situation look an ugly turn and violent mob gathered in the main chowk . To disperse the mob and tackle the situation the army personnel resorted to firing, resulting in death of two persons besides inflicting injuries to some youth. In this regard, case FIR No. 131/2016 u/s 302 RPC stands registered in Police Station Handwara," police said. That, in the meantime situation in the Handwara, got out of control and a pal of gloom fell on the whole area. "Under these circumstances, the husband and daughter of the petitioner feared for their lives and requested for protective custody. Accordingly they were allowed to stay in the police station for a night, to stay safe and all necessary protective measures were taken," the report added. That, the witnesses were were taken to Chief Judicial Magistrate Handwara and the later ordered Judicial Magistrate to record the statement of both of them. "The victim and her father corroborated their earlier version and the contents of FIR that stands registered in this behalf," police said. The police further said on the written request of the petitioner's husband a safe asylum, which in deed was chosen by the petitioner's husband, was arranged for them and all the necessary measures for their safety were ensured. The PIL filed by Kashmir High Court Bar Association seeks seeking a high level judicial inquiry by a sitting high court judge into the alleged molestation incident in Handwara and subsequent violence. A division bench of the court comprising Justices AM Magrey and Tashi Rabstan issued a notice to government for filing its response by April 26 to PIL. It also urged advocate general to assist the court on next date of hearing, posted at 10:30 am onApril 26. |
