jammu, Apr 21: Third additional sessions judge, Jammu, Kishore Kumar has rejected the bail application of an alleged rape accused. The case against Mohammad Farooq, son of Mohammad Dar of Malhar in Billawar, Kathua, was registered on the basis of a written complaint lodged by the victim's mother at Domana police station on May 15, 2015. In her report, she stated that her daughter went to her maternal uncle's house on May 11, 2015, but did not reach there. A missing report was then lodged with police in this regard. She later came to know that Farooq had abducted her daughter and taken her to some unknown place, she alleged. During investigation, police came to know that Farooq had taken the girl to Kanpur, UP, confined her in a room and repeatedly raped her. Farooq had pretended to be a Hindu, introduced himself to the girl as Rahul and then developed intimacy with her. After investigation, offences under sections 376, 366, 343 of RPC were established against the accused. The judge observed that the offence allegedly committed by the accused carried punishment of life imprisonment and being serious in nature, it was considered to be a menace and threat to the society as a whole. "The accused resorted to such activities which demean the psychological development of a woman. The crime of rape is not only a crime against a woman, but it is a crime against the whole society. No doubt, personal liberty guaranteed to the accused is undoubtedly his valuable right under Article 21 of the constitution but the same can be refused to the accused in accordance with the procedure established under law," the judge observed. Keeping in view the afore-mentioned facts and circumstances of the case, the nature and seriousness of the charge, the bail application was rejected, the judge ordered. (JNF) |
