Agriculture employees allege discrepencies in DPC proposal, seek inquiry | | | Early Times Report Jammu, Apr 21: Agriculture Gazetted Employees have appealed Governor NN Vohra, Chief Minister Mehbooba Mufti to hold an independent inquiry in the Departmental Promotion Committee (DPC) proposal of department, alleging discrepencies in the proposal. As per memorandum forwarded by officers it is being maintained that APD constituted/ notified a committee of the following officers vide G.O. No. 144-Agri of 2013 dated 05.04.2013 to finalize the seniority list of J&K Agriculture (Gazetted) Services for their elevation to the next higher rank as provided under rules. They alleged that the Committee constituted, needed to be reviewed and re-notified as most of the members stands transferred/retired. Only then the finalization of the seniority list for elevation to the next higher rank as provided under rules will be valid/justified. The action of the Government on non bonafide committee is unconstitutional and illegal, they alleged. They further said that the HC in the clubbed writ petitions No. 44/2009, titled Chiranjeevan Razdan & Others Vs State and others, vide its order dated 8.04.2010, has directed the state respondents to place the matter before the DPC/PSC for regularization of officers in accordance with the rules and directed to the official respondents'. "In these circumstances, it is just and proper to direct the Administrative department to place the matter before Public Service Commission/DPC for its examination and final orders. Accordingly, all these petitions are disposed off on the consensus of learned counsel for the parties, with the direction to the official respondents to place the matter along with final seniority list of all the Gazetted officers prepared by the official respondents who are in the zone of consideration before the State-Public Service Commission/DPC within a period of two weeks from the date copy of this order is served upon them. The State Public Service Commission/DPC shall finalize the matter within a period of six weeks from the date it is placed before it. The State- Public Service Commission/DPC shall on finalization, make recommendation to the Government for appropriate orders. Meanwhile, Govt. Order No: 279-Agri of 2008 dated 7.10.2008 impugned in these petition shall remain subject to out-come of the finalization of the matter by the Public Service Commission/DPC." "DPC/PSC is requested to complete the seniority list for 615 officers of Class VII who are in the zone of consideration as per the Court Orders. Conduct of DPC/PSC on the inconclusive seniority list is contemptuous and unfair and needs to be looked into", they said. They also said that the PSC should have not accepted/considered the impugned order 359-Agri. of 2005 read with G.O. No. 283-Agri of 2015 without review of the minutes dated 09.11.2005 by including 22 posts of SMS-II (Class-V). The same is required to be done before proceeding any further inthe matter. Leveling allegations against former commissioner secretary, they said that the role of Ex. Commissioner/ Secretary to Govt. APD, Under Secretary to Govt. APD Maqbool and Chairman DPC and Secretary PSC needs to be investigated. "Needs to be probed as how come integrity has been issued in favour of officers who have swindled govt. money Worth crores of rupees but have been considered for promotion illegally in DPC proposal furthermore having excess period in favour of officers decided as Dies-Non by govt. as position of these officers was required to be re-notified inClass-VII under SRO541 of 1999", they requested. They also said that a probe should be ordered as what was the compulsion which lead Commissioner/ Secretary to Govt. APD and Chairman DPC to ignore preference clause while filling up Class-VI posts Category 1(a). "It was aimed to adjust blue eyed in-eligible Officers while formulating DPC proposal submitted to PSC by Agri. Production Department. Moreover, the stand taken by the DPC/PSC in its earlier proposal dated 22.09.2003, 09.11.2005 and 17-11-2006 which have attained finality in the same matter is dubious and prejudiced", they said. They also requested a probe into the role of Chairman DPC Agriculture Lal Chand and Under Secretary to Govt. Agriculture Production Department Maqbool and Secretary PSC, as how come such benchmarks have been ignored while deliberating on DPC proposal. |
