Murder accused denied bail 10/26/2016 11:00:58 PM Early Times Report Jammu, Oct 26 : Principal Sessions Judge, Kathua, Vinod Chatterji Koul has rejected the bail application of a murder accused. Accused Sohan Singh, son of Samunder Singh of ward No 10, Kathua, had on December 30, 2012, allegedly inflicted a serious injury on the head of the victim who had succumbed to his wounds the next day. Till date, no prosecution witness was examined as the case proceedings had been stayed by the Supreme Court vide an order on March 20, 2015. After hearing the two sides, the judge said the grounds put forth by the petitioner 'do not appear to be sufficient in any case to exercise the discretion in his favour. He has been charged for the commission of offence punishable under section 302 of RPC, which carries a punishment of death sentence or life imprisonment'. "An accused cannot be admitted to bail in the case, where he is facing the charge for commission of offence which carries punishment of death or imprisonment for life. There is a sufficient evidence on record to prima facie show that he has committed the offence punishable under section 302 of RPC. In view of the seriousness of the accusation, there is every apprehension that he will misuse the concession of bail if granted and may jump over the same and will tamper with the prosecution witnesses," he observed. "There is no ground made out by the petitioner for exercising the discretion of releasing him on bail. As such, the prayer is declined. Thus the petition for grant of bail is found to be without any merit at this stage.
