Illegal permission of apartments by JDA to SRK Associates at Sunjwan

Jammu, Oct 26 : In a PIL, alleging grant of illegal permission by JDA to M/s SRK Associates for the construction of 366 apartments at Chatta Sunjwan here, a high court division bench of Justice Alok Aradhe and Justice B S Walia today directed secretaries of GAD and Housing and Urban Development Department (HUDD) and JDA vice-chairman to file their response within three weeks.
The petitioner had sought directions to the chief secretary, secretaries of GAD and HUDD and JDA VC to initiate appropriate action against all those officials of JDA who had miserably failed to take action against SRK Associates on HUDD directions conveyed vide No U&D/15/2008/JDA/AS-32 on February 5, 2008, whereby then JDA VC had been directed to take further necessary action to put on hold the building permission granted in favour the builder in March 2007. The petitioner has also sought a direction to the government to take appropriate action against the builder.
The petitioner has alleged that after ignoring five members of BOCA of JDA, then JDA VC had illegally granted building permission in favour of SRK Associates for the construction of 366 apartments at Chatta Sunjwan.
His counsel submitted that the bench had in September 2015 and on November 3, 2015 issued notices to HUDD and JDA VC to file their response but till date no response had been filed by them.
He submitted that since the builder was a highly influential person and had strong political connections, JDA did not take any action against him even after the lapse of almost eight years.
He alleged that the matter was being hushed up to just shield some JDA officers who had abused their official position to confer undue favour on M/s SRK Associates.
After hearing the counsels for the petitioner and respondents, the bench directed the respondents to file their response within three weeks from today. (JNF)
