| Contempt proceedings against SHO in case of alleged rape, impersonation | | Directions issued to appear in person on Nov 3 | | Early Times Report
Jammu, Nov 1: Sub-Registrar Court (JMIC) Jammu today issued notice against Sajjad Haider, Station House Officer, Channi Himmat, seeking his personal presence on November 3, 2016 for allegedly committing contempt of Court in the matter of Complaint titled "Major Harnam Singh V/S Mandeep Kour alias Manpreet Kour dated 17.10.2016 forwarded to SHO Police Station Channi Himmat , Jammu under Section 156 (3) Cr.P.C for registration of FIR under the relevant sections of RPC for impersonation allegedly committed by Mandeep Kour in the complaint that she had filed in the police station Channi Himmat 26.09.2016 against the son of Major Harnam Singh and allegedly implicated him in a false and fabricated rape case.
"Said Mandeep Kour has dubious character and is giving different names at different police stations and therefore is trying to impersonate and play fraud with the investigation of the case and has therefore falsely implicated the son of the applicant", alleged complainant.
The applicant Major Harnam Singh in his complaint filed in the court of Sub-Registrar (JMIC) Jammu alleged that challan, presented by the police station Katra in FIR no. 44/16 dated 19-03-2016 under section 188 of RPC and 48-A Excise Act, in their possession wherein the accused in the said challan disclosed her name as Rupinder Kour alias Kirandeep Kour wife of Gurdeep Singh of H. No 461, Sarkar Patti, Kot Khalsa, Amritsar Punjab and also gave another residential address which is H.No.461, Model Town Jalandhar, Punjab. It is also alleged by the complainant that she produced her passport bearing no. M4827009 wherein her name has been written as Rupinder Kour with residential address H. No 461, Sarkar Patti, Kot Khalsa, Amritsar while on finger print sheet is Model Town Jalandhar.
Applicant alleged that his son namely Jatinder Singh has falsely been implicated by the accused in FIR no. 94/16 registered at Channi Himmat police station under section 376/120 of RPC and the accused has manipulated and forged the documents like passport, identity card etc wherein she has written her name as per her own choice for which is required to be dealt under Law.
To verify the credentials of Mandeep Kour, who had allegedly filed a false rape case against son of Major Harnam, complainant approached the police station Channi Himmat on 05-10-2016 with a written application for lodging FIR against the accused person but no action has been taken by the SHO concerned.
Feeling aggrieved, the applicant on 13-10-2016 made a written application to the SSP Jammu seeking registration of FIR against the accused and the complaint was sent to the SSP Jammu through post.
Following the inaction of police, Major Harnam filed a complaint before the CJM Jammu which was transferred to the Sub registrar Jammu for further action.
After hearing the counsel for the complainant i.e Major Harnam the Sub Registrar Jammu issued direction to the SHO Channi Sajjad Haider for registration of FIR against the Manpreet Kour who allegedly has been changing her name as per her connivance and wishes.
The SHO Channi was also directed by the Sub Registrar to appear in person few days back and on his appearance before the said court he was directed to submit compliance report of the registration of FIR on 28-10-2016.
Despite the time that was given to the SHO by the court, the officer has miserably failed to register the FIR and aggrieved of his inaction today Major Harnam approached the same court for initiating Contempt proceedings against the reluctant SHO.
Taking cognizance of the matter, Sub Registrar Jammu today initiated contempt proceedings against Sajjad Haider and issued summons to him directing to appear in person on November 3 and file objections to the contempt petition that has been filed against him for not implementing the order 17-10-2016 passed by the Sub Registrar Jammu. |
