DB directs JDA to produce record or VC-JDA remain present personally | Quashing of advt of JDA Plots in Birpur | | Early Times Report
Jammu, Apr 3: In a petition filed by Ashok Singh and others seeking quashing of advertisement of JDA regarding allotment of plots in village Birpur, a Division Bench (DB) of state High Court comprising Justice Mohammad Yaqoob Mir and Justice BS Walia, granted time to produce record and in case same is not proceed, the vice chairman JDA remain present on next date of hearing. After hearing Adv RS Thakur appearing for the petitioners whereas Adv Adarsh Sharma appearing for the JDA, the Division Bench observed that counsel for the petitioner that land measuring 215 Kanals covered under Survey No 1845/1734 situated at Village Birpur have never been transferred to the JDA and same has been in continuous possession of the petitioner since the times immemorial and they have certain rights which have accrued upon them in view of the latest legislation. Upon this Division Bench asked counsel for the JDA to show as to whether this land with specifications, as claimed by the petitioner to be in their possession has been transferred to the HJDA authorities. Division Bench granted the same ordered that in case same is not proceed, the chairman JDA remain present on next date of hearing and explain his position. Petitioners are seeking declaration from the JDA to the extent that notification doesn't and shall not relate to the land measuring 215 kanal in Khasra No.1845/1734, which is in possession of the petitioners and other land belonging to them in the village.
