Mother acquitted from infant daughter's murder as prosecution failed | | | Early Times Report
JAMMU, Apr 13: Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Shahmim Akther who allegedly killed her seven months daughter as prosecution failed. Principal Sessions Judge Poonch Jaffer Hussain Beigh after hearing both the sides observed that the prosecution has failed to prove that the accused has committed the murder of the deceased. With these observations Court acquitted the accused. According to the police case an information was entered in the Roznamcha as Report No.19 dtd 18/8/2009 for proceedings u/s 174 CrPC following a that a sven month old female child namely Rifat Bi was found dead under suspicious circumstances at Ghani. During investigations it was established at about 10 am Khatija Bi and Mst Waziran Bi had a quarrel over a land dispute and as Waziran Bi was beating Khatija Bi which was not tolerable to the accused Shahmim Akther who in a bid to teach a lesson and then with criminal intention forcibly struck her daughter on the stone as a result of which Rifat Bi received grievous injury and succumbed on spot. The Shahmim Akther started weeping and raising cries that her daughter has been killed by Rashid etc. In this way offence u/s 302 RPC was established against the accused Shahmim Akther. |
