New PP replaces tainted PP in Budgam sessions court

Srinagar, May 9: The government has finally appointed a new Public Prosecutor (PP) in Sessions Court Budgam after the tainted Public Prosecutor who remained in news for more than a year was sacked a few days back by it.
As per the information available, advocate Mohammad Rajab has been appointed as new PP in the district and sessions court, Budgam. The Law Department issued orders for his appointment Thursday, replacing Sheikh Nayeem against whom several alleged corruption charges have been framed by the State Vigilance Organisation.
This development took place after the recent high court intervention, forcing the government to sack the PP.
Pertinently, the high court had taken cognizance of a petition moved by a Budgam resident wherein Justice Ali Mohammad Magray had directed the law secretary to consider the removal of PP in view of his tainted track record. Petitioner Javaid Ahmad Sofi, a resident of Kremshore, Budgam, had alleged that the PP was trying to give undue benefit to the accused who is under detention in central jail Srinagar under charges of murder of his sister.
The murder case was pending in the Budgam sessions court for the last 10 months and Javaid Ahmad Sofi alleged that the PP was trying to help the accused in lieu of illegal gratification. In this regard, he had earlier requested Law Secretary to appoint a Special PP so that there was no undue influence on part of the incumbent PP. Javaid's request was not accepted by the government earlier and this forced him to move the high court.
Justice Ali Mohammad Magray issued an order on April 30 last, directing the government to take action against the tainted PP. The order reads as " Secretary to Government Law Department shall consider the removal of Public Prosecutor and also explore the possibility of appointment of Special Public Prosecutor in the case and report compliance on next date of hearing."
