Denial of information under RTI SIC reprimands PIO | Directs furnish information free of cost within week | | Avinash Azad

Jammu, May 9: State Information Commission reprimanded Public Information of Officer (PIO), Divisional Commissioner Jammu for not furnishing information under RTI act. According to case (SIC/J/A336/2015/14) history Rashu Kanna moved an application on December 1, 2014, before the PIO seeking information of quires i.e. furnish certified copy of communication vide no. RRCM/HQA/549-54 dated 19-05-2012 sent from O/o the Relief & Rehabilitation Commissioner (M), Jammu, furnish certified copy of communication vide no. RRCM/PS/14 dated 14-10-2014 sent from O/o the Revenue & Rehabilitation Commissioner (M), Jammu, furnish the certified copies of information if any representation has been received on aforesaid matter from O/o the Relief & Rehabilitation Commissioner (M), Jammu/Individual/Members of Apex Committee/inmates of Township Nagrota/till date after construction of said Township under Ex-PM PM's Reconstruction Plan for J&K announced on 17th/18th November,2004 and furnish the information action taken report vide aforesaid communication's till date under "life clause & moral ethos safeguarding lives/Rights under preservation of Human Rights of an displaced Individual/Society" in their own country. But sought information was provided even after lapse of fix time, feeling aggrieved of inaction on the part of the PIO the information seeker filed 1st appeal dated 05-01-2015 before the Divisional Commissioner, Jammu. The perusal of the record shows that the 1st appellate authority has not heard and adjudicated the appeal filed by the appellant. The appellant feeling aggrieved of inaction on the part of the First Appellant Authority (FAA) preferred 2nd appeal dated 09-03-2015 before the Commission. The Commission after receiving the 2nd appeal listed the matter for hearing on 09-04-2015 and both the parties were present. During the course of proceedings, the PIO, Sushil Kesar, Assistant Commissioner (Revenue Attorney) with Divisional Commissioner, Jammu submitted counter statement vide no. 601/RA/RTI /07-08 dated 08-04-2015 and apprised the Commission that application of the information seeker was forwarded to the Relief Section of his office for furnishing the information however, no information came forth from the concerned section regarding para1, 3 and 4. But after a thorough search of record a letter regarding para 2 of the RTI application was traced and information was submitted to the applicant vide letter no. 601/RA/RTI/62/1576 dated 21-02-2015. The PIO further submitted that the delay was caused due to time consumed in tracing the information as it did not pertain to the office of Divisional Commissioner, Jammu but pertained to the office of Relief and Rehabilitation Commissioner (M), Jammu. The stand taken by the PIO is justified in the facts and circumstances of the case and he is directed to transfer the RTI application of the information seeker U/s 6(3) to the office of Relief and Rehabilitation Commissioner (M), Jammu immediately so that the information sought by the information seeker is made available to him expeditiously and without any further delay in the matter. The PIO is further directed to furnish the revised information regarding para 4 of the RTI application relating to action taken report if any, by his office to the information seeker free of cost within one week from the date of receipt of this order under an intimation to the Commission. |
