Jeweler among four charge sheeted in cheating case | | | Bivek Mathur Early Times Report Jammu, May 21: A local court Thursday charge sheeted four persons including a jeweler for cheating. They have also been booked for hatching a criminal conspiracy against one Tapeesh Dutta. The acused have been identified as Aradhana Kumari, her husband Rajesh Kumar, one Iftikhar Salaria and Jeweler Jawahar Lal have been charge sheeted by Municipal Magistrate Jammu for the commission of offence under section 420/120-RPC. The learned magistrate observed that on 30.01.13 the complainant Tapeesh Dutta son of Sant Ram Dutta resident of House Number 105/2 Vikas Nagar Jammu moved a written application in English dully endorsed by the Court of Special Mobile Magistrate Passenger Tax Jammu alleging a lady namely Aradhana Kumari from the neighborhood approached the complainant in March 2012 and pleaded that she is in dire need of ten lacs for the construction of her house at Indira Vihar Old Janipur Jammu against which she wished to keep her golden ornaments with the complainant as security. The complainant, a Military Engineer Service retired employee having father-daughter kind of relationship with the lady without doubting her intentions advanced the money in lieu of the golden ornaments as security and interest @Rs. 25000 to the lady. The lady, as per the charge sheet paid the money @Rs. 25000 for some months but later on after November 2012 stopped payment of the interest and on enquiry she flatly refused payment of interest to the complainant in presence of her husband at her house. She even asked the complainant to sell the gold ornaments kept as security by her with the complainant and take back her Rs. 10 lacs and remaining amount be returned to her. The complainant, Tapeesh Dutta, on 12.01.2013 along with his wife went to the shop of husband of the accused and requested him to accompany them to a jeweler for disposal of the gold ornaments. On this, the husband of the accused asked the accused to accompany the complainant and his wife. The judgment further reads that, the complainant, his wife and the accused later on went to the shop of Punnet at Jain Bazar, Jammu who had previously weighed the gold ornaments, to determine the value of the gold. Thereafter they went to another jeweler at Jain Bazar, Jammu and after verifying the rates from him the accused asked the complainant to go to one of her known jeweler M/S Jawahar at Shaheedi Chowk, Jammu on ground that he can give more value for the gold ornaments as he is known to her. The person sitting in the shop, as per the charge sheet after weighing the gold ornaments kept the gold ornaments on the dice/counter of his shop and left the shop on the pretext of bringing money following which the accused suddenly picked up the gold and tried to run away from the shop but was caught by the wife of the complainant. Seeing a crowd near the shop, police personnel intervened and asked the jeweler to return the golden ornaments to the lady from whom the jeweler had taken the ornaments but he didn't return the same. Later on the complainant filed a written complaint with the PS Peer Mitha, Jammu and after investigation concluded that the lady has committed the criminal offence. The court said that the same act of the accused is punishable under the provision of section 420,406, 409,415 RPC, therefore she is liable to be proceeded against and punished under the relevant provisions of the aforesaid code. Later on, on the receipt of this report, FIR number 8/13 under section 420/120 RPC was lodged and the investigation was under taken by Abid Hussain Shah, Inspector Peer Mitha Jammu. The IO has given his report confirming the cheating by the accused. The gold ornaments are now lying with the President of the Jewelers Association. The local court, after hearing the advocate for the accused, and giving reference of a case titled Lalmuni Devi Vs State of Bihar has charge sheeted the four persons for commission of offense under section 420/120-B RPC. |
