Jammu, June 3: In its memorandum sent to prime Minister of India Narendra Modi, leader of opposition Ghulam Nabi Azad, Home Minister Raj Nath Singh and Governor of J&K State N.N. Vohra today on June3,2015, Kashmiri Pandit Conference (KPC) demanded abrogation of Article 370 from the state of J&K at the earliest with the following justifications highlighted by KPC chief Kundan Kashmiri in the said memorandum and stated that abrogation of Article 370 in need of the hour if Indian nation wants to retain Kashmir for coming future. Memorandum highlighted that Article 370 was brought in force temporarily in the state of J&K, therefore, the so- called special status of Jammu and Kashmir was also temporary,it was never meant to be permanent as understood by the forces who want to take the state out of the political and constitutional ambit of India. The analysis of the Article has been based more on rhetoric and less on the actual nature of the Article. it is pertinent to mention the provisions incorporated in the Article 370 that empowered the President of India to transfer powers to union with regards to such other subjects in the union list and the concurrent list of the 7th schedule of the Indian constitution which the President specifies with concurrence of the state Govt. and extend to the state with such modifications and expectations as the President of India would specify. It is, therefore, ample clear that there is nothing in the above mentioned that makes the Act sacrosanct. The in-depth perusal of Article 370 shows clearly that there is no limitations in terms of amending it. thus there is no hurdle in abrogation on the Act, if the Indian parliament, so, desires. |
