Srinagar, June 3: Division Bench of high Court comprising Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey today directed the Chief Executive Officer of Gulmarg Development Authority (GDA) to inform it as to whether all encroachments on state land Gulmarg have been removed and to file affidavit regarding removal of encroachments by or before June 10 A Division Bench of Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey directed the CEO to file the affidavit by or beforeJune 10 and said, "In the affidavit, he (CEO) must give details about the persons who were in unauthorized occupation of the state land or had encroached upon (it); how much land was encroached upon or was in their occupation and how much land has been retrieved and possession taken thereof. The Division Bench also directed the Commissioner Secretary J&K Tourism to inform the court about the total area of Gulmarg Valley. "He shall also indicate in the report as to how much area as on date in built-up area," the bench said. It also reiterated direction to the government not to permit any constructions in the Gulmarg till the new master plan, he added. The Division Bench also directed the Principal Chief Conservator of forest to file an affidavit before June 10, indicating how many trees were there in Gulmarg. Regarding the fencing of the land retrieved so far, the CEO informed the court that because of the thick snow cover, it could not be fenced. Earlier Advocate General R A Jan submitted that in order to preserve the scenic beauty of the world famous tourist spot, appropriate decision was required to be taken in consultation with experts for fencing of the retrieved land ensure the scenic beauty of the area is not harmed. Advocate General also submitted that the chief executive officer has informed him that possession of all the retrieved land has been taken over by the authority. |
