Allotted 2200 Sq ft land to JDA employee illegally, filed false affidavit in Court | Another blot on Director ERA's face | | Sumit Sharma Early Times Report jammu, July 13: Vinod Sharma, presently posted in ERA as Director (safeguards), during his posting in JDA was not only involved in grabbing JDA land in Trikuata Nagar but also is alleged to be instrument in extending illegal help to JDA employee by allotting prime land measuring 2200 square feet in his favour in Trikuta Nagar area. The land in question is situated adjacent to Trikuta Nagar Police Station. Further to cover his misdeed, he filed a false affidavit in the High Court. This startling revelation is made in the Status Report submitted by the SVO in the Court. As per the Vigilance Report during verification of the additional allegations against some suspects/department i,e JDA it was found that one Guest House under the name and style of M/S Shirdi Guest House is being run on the land in question which has been projected as idle land in the affidavit to this effect before the High Court. The vigilance started investigation after it received complaint that Vinod Sharma has not only himself grabbed the JDA land but also has extended illegal help to other persons to prevent their allotments from being cancelled. The complainant further alleged that Vinod Sharma illegally helped one R.P Gupta, s/o Bindraban Gupta, R/O107 -A Trikuta Nagar an employee of JDA, Jammu by allotting additional land measuring 2200 square feet in his favour and to cover his misdeed, Vinod filed false affidavit in OWP 1218/2014 in the High Court stating therein that the additional land allotted to the RP Gupta is not having any commercial potential. After completion of the verification, the VOJ vide no SSP/very/2014/682/VOJ sought consent from Central Office of VOJ to register FIR in this connection. The Central Office vide no SVO- Veri-Jmu -11/2013 directed for draft of FIR which reads as, " Both the complaints were clubbed and a joint report was submitted to the Central Office VOJ involving Vinod Sharma who remained posted in JDA in different capacities. During his initial posting, Vinod Sharma, by abusing his official position, facilitated transfer of 4300 sq feet of land illegally in favour of his wife namely Mamta (Gupta) Sharma and in the second instant as VC JDA rejected the application of the applicant on the ground that the land is commercial and not a s trip and at the same time, while giving undue benefit, allotted 22000 sq feet of the same type of land to a JDA employee." Vigilance report further said that during further verification, it was found that the accused Vinod Sharma had demolished a temporary structure raised in Trikuta Nagar in spite of status-quo order from the lower court and thereafter initiated process of auctioning of the land in question by issuing auction notice placed on record. Pertinently, Vigilance Organization registered case FIR No.18/2014 u/s 5(1)(d), read with 5(2) J&K P.C.Act Svt.2006 and 120-B RPC in Police Station Vigilance Organization, Jammu on the basis of verification conducted into allegation of illegal allotment of Plot No. 42 Sector 1-A Trikuta Nagar Jammu and grabbing of additional land against S/ Shri Vinod Kumar Sharma, then AEE/VC JDA, K.L Vuthoo, then VC JDA (now Rtd), Prith Pal Singh Betab, then Secretary JDA (now Rtd), L.K. Mengi the Executive Engineer, JDA (now Rtd), Satish Nehru, then DLM JDA, Romesh Koul, then CTP JDA (now Rtd), Smt Mamta Gupta (Sharma) w/o Vinod Sharma and other officers / officials of JDA. During the year 1980, JDA acquired land from various persons / land owners for developing housing colony at Trikuta Nagar, Jammu. As per Govt Order No 171 UD of 1984, it was directed to allot a residential plot to the 38 families from whom the land was acquired at Channi Rama against a payment of Rs 3,000/- per Kanal as rehabilitation charges. Shri Prem Nath whose land was also taken by JDA approached for allotment of a plot in his favour but the allotment was delayed for unknown reasons. Shri Vinod Kumar Sharma, Ex- Vice Chairman, JDA who remained posted in JDA till 2011 in different capacities (except the period from July 2006 to May 2010) developed a greed to grab the plot and managed to persuade Prem Nath through one Kewal Krishan R/O Purani Mandi to take Rs 3 Lakhs from him in lieu of plot of land measuring 5400 sq.ft. which was to be allotted in his favour. A lease deed stands executed between JDA and Prem Nath. However, before execution/registration of said lease deed, said Prem Nath was made to sign power of attorney where under he empowers Smt. Mamta Gupta w/o Vinod Sharma as sole attorney of the said plot. This Power of attorney has been produced and registered before Court of Sub Registrar, City Jammu on the same day on which lease deed was registered. In this way in pursuance of well planned conspiracy the accused grabbed JDA land worth lakhs of rupees. Enquiry further revealed that after taking illegal possession of said plot, Smt Mamta Gupta (Sharma) with the active connivance and help of her husband Shri Vinod Sharma managed to grab illegally an additional land of 5200 sq.ft. thereby making a total illegal possession of 10600 sq.ft. Accordingly case FIR No.18/2014 P/S VOJ was registered and the investigation taken up. |
