Jhelum encroachments: HC issues show cause notice to DC Anantnag | | | Early Times Report Srinagar, Aug 14: A division bench of J&K High Court has issued a notice to Deputy Commissioner Anantnag, asking him to explain why legal proceedings may not be initiated against him for violating court orders about removal of encroachments along water bodies including the Jhelum. "The Deputy Commissioner Anantnag, who along with Deputy Commissioner Pulwama was present before the court on last date of hearing, though had sought four months for removing illegal encroachments from the water bodies including that of Jhelum, was given three months for removing the same. It was further directed to file status report and action taken report before the Registry fortnightly. The DC Anantnag has not complied with the court order," the bench comprising Justices M H Attar and A M Magrey observed. It directed court's registry to issue show cause notice to the DC Anantnag to explain why proceedings under law may not be initiated against him. Meanwhile, the court also granted a week's time to those engineers who have not filed response to the notice issued to them by court, seeking their reply as to why they shall not deposit Rs 25 lakh each for dereliction of duty with regard to maintaining and preserving of Padshahi canal, an age-old irrigation passage which takes off from nallah Sindh near Wayil bridge in Ganderbal district. On last date of hearing, the court had observed: "We are prima facie satisfied that there has been absolute dereliction of duty and connivance of the concerned engineers with the encroachers, which has resulted in near extinction of the Padshahi canal." The court's efforts to preserve and protect the water bodies, the division bench had said, will not bear fruit until such time the officers who are in position at the moment, learn to respect the laws. The division bench observed some stringent action was required to be taken against those who remained posted in the areas through which Padshahi canal runs. "At this stage, we issue show cause notices to all the engineers, asking them to explain as to why they shall not be directed to deposit Rs 25 lakhs each in the state treasury and the amount would be spent for preserving and protecting the water bodies and for restoring them to their original width," the division bench had said and asked the engineers to file their response before the court. |
