HC disposes of PIL regarding CET paper selling scam | | | Early Times Report
Jammu, Aug 26: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi today disposed of the PIL in CET paper selling scam in the Board of Professional Entrance Examinations. The PIL was initiated on the basis of a letter written by Justice Muzaffar Hussain Attar to the chief justice, pointing out the cancellation of Physics and Mathematics papers of Common Entrance Test (CET) 2013 for selecting students in MBBS and various other professional courses on account of leakage of question papers due to the fault committed by the persons responsible for conducting the said examination. The scope of the writ petition was enlarged regarding the conduct of CET examinations conducted to select the candidates for MBBS and other professional courses for earlier academic years. After receiving notice from this Court the Crime Branch, Kashmir registered FIR No 24/2013 and conducted the investigation and this Court was monitoring the investigation pf CET examinations conducted for the academic years 2009, 2010, 2011 and 2012. After investigation it was found that in the CET Examination of 2012, the question papers as well as the key answers were sold before conducting the examination and criminal challan against 51 accused persons was presented before the Special Judge Anti-corruption Kashmir, Srinagar on January 12 last year. In so far as the examinations conducted for selections for 2009, 2010 and 2011 are concerned, after thorough investigation no malpractice could be noticed by the investigation agency and the status report filed by IGP, Crime Branch dated August 17, 2015 explained the manner in which the investigation was conducted and the closure of investigation. In the said status report it is stated that, from the perusal of the record provided by the BOPEE, it is revealed that 896 candidates have been selected for four medical colleges of the State, namely, Government Medical Colleges of Srinagar and Jammu, SKIMS and ASCOMS. The said colleges were addressed for providing the academic performance of the said candidates in the MBBS/Feeding Class, which were furnished by the Medical Colleges concerned. All the said certificates were examined and random samples were taken for in-depth verification, numbering 109 of four Colleges admitted in all the three years. The said candidates were summoned to attend the Crime Branch and they also appeared. It is stated in the status report that the Crime Branch during investigation found that even average merit candidates in the feeding class got qualified in said examination in their 2nd, 3rd or 4th attempt and some of the candidates got selected in different streams in earlier CET examination but left those streams and attended the subsequent CET examination to get admission in the courses of their choice. The candidates admitted have also performed satisfactorily in the MBBS course. The students admitted in 2009 batch have passed out and only four students have backlog of papers and three out of four are from the reserved categories. 2011 batch students are in pre-final year. The bench observed that in so far as CET examination 2012 is concerned, after conducting investigation charge sheet was filed on 12.01.2014 and then Chairman of BOPEE was shown as accused No 1. The case has been registered bearing Criminal Challan No 42/B and the matter is being tried by the Court of Special Judge Anticorruption, Kashmir, Srinagar and according to the AAG, out of 78 listed witnesses, six have already been examined. Coincidently, when this matter was heard the bail application filed by then BOPEE Chairman also came up for hearing and after considering the merits the bail application was dismissed on 20.08.2015 with a direction to the Special Judge Anticorruption, Kashmir, Srinagar to dispose of the criminal challan on day to day basis within a period of six months and report was directed to be filed by the Registry by the learned Special Judge Anticorruption, Kashmir, Srinagar after concluding the trial in accordance with law by the end of February, 2016.
