Early Times Report Jammu, Nov 30: Principal Sessions Judge Udhampur R S Jain today awarded seven years rigorous imprisonment to Rahul Sharma for rape with a minor and also awarded three years RI to Ganesh Kumar and Pawan Sharma who co accomplice of main accused in kidnapping of minor. After hearing both the sides, Principal Sessions Judge Udhampur R S Jain observed that for the offence u/s 363 RPC, accused Ganesh Kumar and Pawan Sharma are sentenced to undergo Imprisonment for a period of three years and sentenced to pay fine of Rs 5000/-. "In default of payment of fine, they shall further undergo Simple Imprisonment for one month whereas accused Rahul Sharma is sentenced for offence u/s 363 RPC, to undergo Imprisonment for a period of Three Years and sentenced to pay fine of Rs 5000/-, in default of payment of fine, he shall further undergo Simple Imprisonment for one month and for the offence u/s 376 RPC, accused Rahul Sharma is sentenced to undergo rigorous Imprisonment for a period of Seven Years and sentenced to pay fine of Rs 25000/-, in default of payment of fine, he shall further undergo Simple Imprisonment for two months, court said, while adding, "both the sentences shall run concurrently. As per prosecution case, on 6/10/2011 written complaint was filed in police station Ramnagar by Mohd Ayub to the effect that on 5/10/2011 at Kirmu near Plasan Road, his minor daughter (name withheld) at 6 PM, had gone to the field to cut grass was found to be missing. He alleged the duo of Ganesh along with Pawan Kumar driving one vehicle Mahendra (No.8090) having a common criminal intention enticed his daughter into the vehicle and kidnapped her and took her towards Morh Plasan towards the road though complainant alongwith his family blocked the road with stones but the accused forcibly drove towards Udhampur. On receipt of this complaint FIR No.142/2011 for offence u/s 363 RPC in Police Station Ramnagar. During the investigation, medical examination of the prosecutrix was got conducted from the hospital and found to be minor. Following the statement of the prosecutrix, offence u/s 376 RPC was added.
