Fix appointment, seniority as per merit position: HC | | | Early Times Report
Jammu, Jan 4: The state High Court today held that appointment and seniority would be fixed on merit position as per the selection list. The court directive came in a petition, seeking quashment of the selection list of junior stenographers in so far as it pertains to the allocation of General Administration Department (GAD)to respondents and a direction to the state to allocate GAD to the two petitioners too keeping in view their merit position in the select list. The court, after hearing the petitioners' counsels, allowed the petition with the direction to GAD commissioner to issue appointment orders in favour of the petitioners as junior scale stenographers in GAD with effect from the date other selected candidates were appointed in GAD. The court observed that the petitioners were litigating over the matter since August 16, 2014. Though selected and recommended for appointment, they have not been able to take the appointment because of the allotment of department by the respondent board in an arbitrary manner. Their appointment, therefore, shall be given effect from the date of issuance of appointment orders in favour of other candidates selected and allotted GAD, though without any monetary benefits, as petitioners are reported to be in-service candidates and to have been gainfully employed during period in question. Needless to state that on their appointment, their seniority shall be fixed with regard to their merit position as per the selection list. In case of a tie, i.e. same merit secured by more than one candidate, rules occupying the field on the date selection process was initiated, shall be followed. Let the entire exercise be completed within a period of four weeks, the court directed. --(JNF) |
